Interesting article. On first looking at it and second thoughts it could set an unfortunate precedent if they succeed. After reading some of the comments, I do believe that accessing Craigslist after an explicit warning not to regardless whether the doors are wide open or not is an infringement. The law could be updated but I feel they have every right to file a lawsuit.

Whether they win or not who knows. But just because you can do it doesn't make it right. And I do believe intent comes into the equation. There intentions were far from honorable and should be dealt with.

They were not posting. They were scraping the listings and re-publishing them.

  • There are more laws in the pipeline that will ban half of what warrior forum members are doing, and this lawsuit will be peanuts

agreed. lots of regulations coming down in the near future. running a web business will not be the wild west of the past. those that dont find a way to do things professionally and comply will get shut down one way or another.

It probably won't decrease the amount of spam on Craigslist since it is aimed at scrapers. Now, if CL filed suits against the payment processors, hosts, and affiliate programs being flogged by spammers, that would be another matter entirely.

I have run into the a similar situation when I tried to post my ad in different states (or cities). CL automatic block sthe ad from publishing despite I have completed the ad and got a confirmation email notification. I contemplate opening mulitple CL accounts using different email addresses. I wonder if this is considered a crime...

I would guess that this in the 9th district court in cali, there are lots of flaws with this ruling.

First off Craigslist is not a business, so saying they are is nonsense. Craigslist prides itself on being open to the public with no commercial intent. The judge is comparing it to a business which it is not.
