Reporting Illegal Distribution

Hey warriors,

I just found out one of my non IM niche products is being illegaly distributed, it is clearly stated in the legal disclaimer that this is not allowed.

I have reported it under a violation of the millenium copyright act, but is there a way I can report and get the site banned?

There is probably no way in which you can totally stop this. I would suggest, however that you use Copyscape's "Copysentry" service in future. This will allow you to place a 'Copyscape Protected' button on your site. Hopefully it will persuade to jerks stealing your material to go and look for easier pickings!

Do a whois on the domain...find out the hosting company. Report it to them along with the proof that it is your product.

  Pirates don't care about copyright notices. The only one who benefits from the Copyscape notice is Copyscape. Putting that on your site is like a bank putting up a sign saying "Don't rob us."
  
  Besides, what does that have to do with a product (rather than web content) being pirated?

  If someone is violating your copyright you can file a DMCA notice with the host and also possibly the payment processor if they are selling it.
  
  If your copyrighted work is listed in Google's search results you can also get them pulled, Google provides the details on what is required for them to do this if you search their policy pages.
  
  And finally, if there are monetary damages, a lawsuit also works.

Daniel, sometimes it helps to write to the person and ask them to stop.

One time I found someone selling one of my products on Ebay. I emailed them and asked them to stop it. They did. It was that simple.

However, it's not always that simple.

Another time, someone started distributing the link for my download page on another product. From the looks of my stats, they were either giving it away, or they were making a lot more money from it than I was, lol. Anyway, they were using one of those services like tinyurl or shorturl or something. I wrote to the service, and told them their service was being used to rip off my product. This was clearly against their TOS, because it was an illegal activity. Do you want to know their answer? They basically said, "Tough S**t!"
They said it was my own fault for not protecting my download page from the thieves.
So that time it did not work.

Anyway, you never know. Sometimes all you need to do is ask.

  Send a DMCA take down notice to both the hosting provider and the domain registrar.
  
  That sometimes gets the desired results depending on the host and registrar's policies.

  I have sent DMCA notices to all the parties involved including the website owner, the hosting company, the download link company and the websites linking to it. The worst part is even the Digital Point forum is linking to it and although it was kindly reported as illegal distribution and sharing, the moderators haven't even removed the thread.
  
  And I thought Digital Point was respectable!
  
  The only ones who have done something is rapidshare where the download link was available.

  Kathryn, I hope you moved your download page so the link they were using would be worthless.
  
  A fun trick is to create a file with the same name as your product, but full of ads or whatever you think would disappoint the thieves, then leave that in the old download area.
  
  I once did this with a pdf filled with the 10 Commandments over and over. I'm sure they enjoyed that one.
  
  I'd also be tempted to report the link shrinker service to their host.

  I love your idea, Jelasco! I'll have to do something like that sometime.
  
  That sale I was having was a limited time only sale anyway, and I had built the website strictly for that sale. It was a Christmas-time promotion. So it came down soon enough. And the thieves only got to use it for a couple of weeks.

  well I am confident if you have brought things in hosting companies attention they will definalty do something against the website , warn them , cause none would want their company to be compromised because of some website .... they are not making that much money off ' of one lousy website ...

  Leakage happens...get over it. The thing you should do is to take pre-emptive measures to ensure that it doesn't get out all over the place. To do this, you have to understand how these guys are getting access to your stuff....Truth be told, most of the 'gurus' stuff that is circulated was found via the search engines using very easy methods (this includes the dl guards that use the referrer as validation).
  
  Truth be told, while it sucks that someone has stolen your stuff (It has happened to me as well), there is very little you can do to stop it other than contacting the hosting company. And by then...the damage has been done.

I decided to snoop about after reading this and, while I didn't find my main for-sale products anywhere, I did find a report I wrote exclusively for members of the Warrior 'War Room'. It was released to them specifically on the condition that it not be circulated outside that group.

So, even among the supposed upper-echelons of groups like this, there exist shitty little pricks.
