Email list: Is this an opt-in?

If someone offers their email so they can download something or gain access to the next page, or whatever, is that technically considered 'opting in'?

Since there isn't usually isn't an agreement form for the person to read and agree to, I'm not sure if this is a grey area.

    I think so. I suspect people don't expect to supply an email address without ever getting an email from the person to whom they give it - otherwise what would be the purpose?

    Thanks Alexa. That's what I'd think too. As I understand it, as long as there is an 'unsubscribe' option in any emails they receive, then it might be ok. At least I hope so. For what its worth, I have read about the anti-spam law in the US and haven't found a specific answer to this.

    I have been doing some list building recently, i am offering "free" ebooks ect just enter email to access, they have to confirm via email but i am sure they will be expecting some sort of email? like tritrian said what would be the point of asking for an email?

    "Technically" that is a single opt in.

    The "agreement form" could be thought of
    clicking on the link confirmation email of a double opt in.

    yes they would be considered an optin and as you mention for you to stay on the right side of the rules etc, you should have a visible unsubscribe area in your mail.

    I would definitely say that it's considered an opt-in. Some people add a note about the fact that they're doing email marketing, but I think most people know why they have to put their email these days.

    Having a double opt-in helps too, if you're using Aweber especially. The confirmation email sent is always fairly specific about what your purposes are.

    Yep, if they provide the email address and you provide the unsubscribe link in each email, you'll be good to go. It helps if you're recognizable and the info you send is related to what they opted in for.

    To be even safer, I have started adding an unsubscribe link at the top of my broadcast emails... If they don't want my emails, I would like to encourage them to opt out rather than complain...

    Ok, so what you ideally want to do is this:

    [EMAIL FORM FIELD HERE]
    *By submitting my email, I agree to the [link]Terms and Conditions[/link].
    [SUBMIT BUTTON]

    Then in your terms and conditions write it ALL out what they are opting into etc.

    BUT, if you have already been collecting this data, it is still opt in, go ahead and mail it.

      Doing it the way brentb suggested definitely seems to make the most sense.

        An email is usually sent shortly after somebody enters their details into your opt in form, asking them to confirm they wish to receive the download or info. So 'technically', that is when they have opted in.

    Yeah i have that, Getresponse are quite anti spam i believe, So i am only getting people who know they will be on a list,

      The only thing I would add is a note in the first email or on the download page alerting subscribers to the fact that they should watch their inbox for additional valuable emails from you.
