Amazon Private Labeling Q&A

I have questions about Amazon and Private Labeling Products for FBA, Merchant Fulfilled etc. Hopefully started this thread will get my questions answered without having to shell out big bucks for some training program.

Maybe if everyone titles their Questions starting with "Question:" and "Answer:" for Answers we can keep this to the point and keep questions and answers organized.

Question:
when private labeling products what steps are taken to ensure you are not infringing on existing design patents, trademarks, etc? Just because I find a product some overseas supplier has I think would be good to private label doesn't mean the product isn't already patented in the US. Does ASM cover this?

      I havent had any experience with the supplements area but I would be cautious with them. While there is good money in that market, there is also the risk of the FDA stepping in. Someone could also get sick or even worse, die from your product. Because your name is on that product you could be help liable.

      Maybe others could give examples of other issues.

    The main thing is that you don't want to go for products from big brands. Look for generic products. For example, cell phone cases. There are literally thousands of them for sale on Amazon but probably (just a guess) less than 200 different styles.

    I learned the hard way with Chinese (or any foreign manufacturer for that matter) manufacturers, if you see a big name brand advertised by the manufacturer, chances are it is counterfeit or at the very least a knock off that will get you in big trouble.

    But there are many products that you can find that are generic. If you are going through one of the many sites that connect you with foreign manufacturers, don't hesitate to ask them straight up, "is this product trademarked to anyone?"
    Most will try to avoid the question or not answer. Run the other direction fast if they can't or wont answer!
