You're asking for big trouble. It is a Trademark.

It's definitely trademark infringement. Of course there are sites out there "getting away with it" because they haven't been caught or Nike hasn't been bothered to take them down yet. One of the biggest advantages of having your own site (compared to say a squidoo lens) is having complete control over what you do. If you give another company the legal right to ask you to take your site down whenever they like you've completely lost that.

Drop the domain immediately before you receive a cease and desist letter. Companies with trademarks monitor domain registrations. If you start to use it expect legal action and costs. They will win and you'll be out of pocket. Why not call it TheRunningShoeShop.com or some other generic domain?

@a1z277- If there's ONE thing you should avoid it's knowingly using a trademarked name in your domain name (if you want any sort of longevity from the site). If you put something on your site, content-wise, you can always remove it upon request, but with a domain name...you're up the river without a paddle. Even if you just decide you're going to ignore any requests from the trademark owner, they can bypass you and go to your webhost to get the content taken down.

Hi a1z277,

While it is true that there are various websites out there with "Nike" in their domain name, there is a countdown timer associated with them. Who knows if Nike will take notice, but if/when they do, they will force them to shut down the domain. By that point, all the time and effort that has been spent in building up this website will have been lost. It's better to start off anew without a trademarked name in your domain name. In this way you will not lose all your work...and you will probably sleep better too...

You will definitely be in trouble with that domain name. Do not make efforts to build and develop your web page with that domain name anymore. It would just be a waste of time. Nike will find out about it sooner or later. I hope you haven’t spent a lot of money on that website yet.

For the most part, yes. Just ensure that how you use the domain name doesn't
confuse people with Nike. If you write about the athletic products company, for
example, it helps to: a) say that you're not associated with them, and b) never
show ads of competing products.

Ianal, they might still give you hassle in such a case, but you would have a more defensible case, if you have the will, energy and resources to fight it

But as soon as you start doing anything to do with footwear on such a blog, etc., then you would undermine your own defense.

Been there on both ends of the issue, worst scenario is you will get a C&D letter and you will have turn the domain over to them. That's not a big deal but losing all of your SEO work is another matter. If you keep it consider it a short term investment.

Just been doing some browsing and came across this site - http://niketalk.com/

They must have permission to use 'Nike' in the domain?

It says this at the bottom:

NikeTalk is NOT affiliated with Nike Inc. in any way, shape, or form.

It says it been open since 99 in the logo, but I've never come across it. Is anyone part of that community? I'm curious about the arrangement that allows them to operate.

NO. if you come across a problem you can always say it means Nick. They cant do anything to you. However be aware that you probably don't want to associate it with any sports. Keep any relevance to the brand away from you and you will be fine. and be sure you tell them it means Nick (it's just a different way of spelling it). and if a lawyer wants to be a dick and tries to force you to justify as to who it is based on, you can say it is a pet you used to have. They seriously cannot do anything to you, no matter how hard they try.

However, i highly doubt this is ever going to happen. Don't worry about your domain name, just keep it away from anything about sports.
