Ok, I have a rather massive collection of music, I see that people are always putting music onto youtube and nothing ever happens to them, although I don't understand if there are any legal implications for me doing this? I'm mostly looking to use the music in a way where my business is also being branded in the videos.. may it be an adveritsement with background music or a slideshow etc etc.. Is this legal..? |

Sooner or later, they'll kill the audio in your video. They've been doing this with videos that are infringing on copyright. You just haven't run across any yet. They have a notice that the audio has been disabled due to copyright infringement.

Buy a license to use it. Or pray they don't catch you. Take your pick. |

For people who upload it, at most, upon request by the companies, YouTube will take down the audio and probably disable the account. However, if you are using it for commercial purposes like list building or directing traffic, you can only use royalty-free music or music which you have license to. Anything else might get you in trouble. Asher |

Well, think about it this way... if U2 decided that the exact moment that you've been using their music without license was chargeable... and they charge you every time your video is played with their music... How much would you have to pony up? Not worth it - just get royalty-free music. You'll be safe and clear to go. Or pay for music licensing. Asher

Hi there: Hope all is well. YouTube through threats from the record companies has removed a plethora of accounts without warnings the past couple of years (last 6 months being really large). Many of the record companies have forced YouTube to invest in a software that more easily sees copyrighted material and has it pulled. Be careful about posting copyrighted material because even if your neighbor gets away with it, you may not. A lot of hard work can go down the drain. Enjoy the day! |

It seems to me that far too many people are doing it for it to be a crime? I'm really determined to do this and not be accused of copyright infringement, think I'll message some youtubers who upload music to see if they know anything about it. |

A crowd of people have gathered on a bridge. They start jumping off. Some survive the fall because they were fortunate enough to land on top of a pile of less fortunate jumpers, which cushioned their fall. But, do you want to take that risk with your business? |

If you do not have permission from the copyright holder to use content, whether it is text or music, then you are infringing upon copyright if you use it. The posters here know what they are talking about. If you don't have permission or a license to use music, especially for commercial purposes, you will eventually get caught. And, if you've been making money off of the music you've been using without a license or permission, that makes it all the more likely that you will not only get the audio removed from your video but that you might face a lawsuit as well if the copyright holder decides they want to go after you for royalties that you should have been paying. Penalties for copyright infringement can start around $25k-$50k, plus they can also go after you to pay their legal fees incurred in going after you. At the minimum, they may only remove the audio from your video, in which case you'll have to redo it anyway, which will take more time on your part. Best to just do it the right way to begin with so you can do more productive things in the future than redoing things you've already done. At worst, they can go after you for fees and legal expenses, which will be costly for you. Why would you knowingly want to put yourself at risk for that? Never mind what 10, 100 or 10,000 other YouTube users might be doing. None of that matters if the copyright holder goes after you. And, "but everyone else is doing it" is not a legal defense.

There are different options. The most expensive, if it is available, is licensing the original work by the original performer. Less expensive is licensing the music but having it performed by someone else. That's why you'll sometimes hear familiar music in TV and radio ads but performed by different people. And, not all music is available to be licensed for commercial purposes.

Youtube DOES have the option to add music to your video from their approved library of songs which is quite extensive |
