Is it OK to launch a competing product which is practically the same as the original?

Hi,

The title says it.

Can I offer -- let's say hypothetically -- a product, which, to all intents and purposes is identical to another?

...only at half the price?

No intellectual property stolen...

Nothing directly stolen, except the idea...and a promise to greatly enhance the product in future revisions?

Allowed or not?

I welcome your opinion!

    Generally speaking, the answer is yes, but this is also the type of thing that you need to get attorneys involved if you really want to protect yourself. Look at things like design, overall structure, and any coding if it involves programming, and make sure it could not be argued easily that you copied these things.

    But it's not a copyrighted idea, as such...

    There is no problem with this at all ... Just look around forum software, article directories, adbrite type sites, script sites (hotscripts), and etc .. The list goes on and on...

    Creating your own products from another idea you seen but you stole nothing, there is nothing wrong with this.. It happens every day..

    I am still looking for that JV ... lol Got an awsome membership script I am fixing to release several warriors have already seen it and I got some great feedback.

    I have idea that is already researched and proven that can bring in $10,000 a month easily.. Just looking for that person that is willing to put out a little money to make a huge return ..lol

        Had you been the original author of an idea would you be comfortable with another stealing your ideal then selling it for less.

        Since you cant deal with someone else promoting on your thread then the answer is NOOOOOOOOOOOOO..

    agree with richjerknet. this is perfectly ok.

    as many of the big players in this industry would say: 'its better to create and own the product and make 100% rather than be an affiliate and make 75%.'

    ok so that wasn't actually a real quote from anyone but it conveys the idea.

    however... the line can be crossed if the material is plagiarized. Trust you wont do that.

    If the same ideas are presented in the same order it could be considered plagiarism. But if you were creating a new product with a new outline that just happened to be based on the same idea, I don't see anything wrong with it!

    As far as I understand....An Idea cannot be copyrighted. So if you go out and create a product based on an already successful idea then there's nothing wrong with that, however general disclaimers do apply, such as no plagiarism, different back-end coding in case of a software product such as scripts and preferably a different format of presentation.

    People do it all the time. Problem is if it's an established product how do you plan on setting yourself apart to attract people who already own the original? What you should do is use the idea and add a little to it for example a couple time saving features. Good luck with your product if you do go forward

    I don't think competing on price a smart move most of the time

    Regarding "stealing" an idea... Ideas are commodities those days so its likely that the person you are "stealing" from did get it from someone else too.

    People copy others' ideas all the time, but people also patent ideas all the time. It's really hard to know what to tell you without knowing the idea, and certainly you don't want to just share that with everybody. Intellectual property is just ideas, and there are I.P. attorneys just looking to sue you in some arenas.

    If you are talking about an information product, then I think you are fine. Just make a better product than your competitor.

      As far as I know usually (many time|always) idea is not copyright protected. Only the method to execute the idea is copyright protected.

      If you are talking about a software, and you code the software from scratch and dount use same graphics or any other thing which is copyright protected. Then you are safe...

      If two people start with the same idea - they will most likely create quite different products. It is unlikely the resultant products will be "to all intents and purposes... identical to another?"

      If you are "enhancing" another product, you are using more than just the original idea.

      We see it done frequently. One product is released - and shortly another similar product is released at a lower price and becomes a competitor.

        even if 2 people start and collaborate on the VERY same idea, but launch, for example, on a different location, the outcome is likely to be considerable different due specific demographic, social ,political and other variables.
