Youtube video - legal advise

Hi,

I need advise regarding legal issues with Youtube video:

1) If I use song which I do not have copyrights but I do minor change in music like adjusting pitches or remixing it. Do you think, I will be in copyright violation row?

2) I make animated cartoon for celebrity or leader like Tom Cruise or Barak Obama, the animated cartoon will be for fun/joke/ humor. Do you think, I will be in any legal trouble?

3) Is it ok with I use news from other websites i-e: www.nytimes.com
and make video using their script/textual content? Do u think, I will be in legal issue?

Thanks

    Ianal.

1 and 3 are almost definitely copyright violations IMHO (unauthorised derivative works).

2 probably depends on the circumstances. Using another person's name or likeness for commercial purposes may infringe their rights. There is also the issue of potential defamation, and probably others too.

As others will probably tell you in a minute no doubt, go find a real lawyer, rather than ask on a message board, if you want legal advice.

With regards to the music question, it is certainly possible to create a sound-alike track that's changed enough to make it a unique, original work - that is, a new recording from scratch that has certain identifiable properties similar to the original that's clear it's influenced by it without it being a direct copy. But to edit an existing copyrighted track without a license? No. And even with the former, I wouldn't advise anyone do it unless they absolutely know what they're doing. It's just not worth the risk of plagiarism.

The bottom line with regards to all your questions: if in doubt, leave it out.

    Yes.

Depends. If it's defamatory (and that's a very subjective term), or it shows them endorsing your product when they clearly do not, yes.

    3) Is it ok with I use news from other websites i-e: www.nytimes.com

If you're copying stuff from their website and passing it off as your own, yes. If you're quoting it and acknowledging the source, probably not. I believe there are limits as to how much info you can "quote" before it becomes an issue.

I'm not a lawyer, so usual exclusions apply.
