Flippa Buyer refusing to Return Domains after Chargeback

For the last 2 months I have been trying to get domains back with the help of a paralegal.
The domains in question were purchased by a buyer on Flippa back in April.
They waited until the last moment to do an item not received chargeback.
Because it's for digital goods I was not covered by seller protection.
So this joker is using the websites I sold him, the facebook and pinterest fan pages and ignoring me totally.
Thoughts on how to deal with him ?
At this point I think outing him on Social Media is the only way to get somewhere.
Unfortunately Flippa wouldn't/couldn't help me because it was so far post sale.

      Well I am searching for helpful advice to avoid this. Apparently another WF member would send out CDs to domain buyers. Very smart. But if there is no buyer address on file with PP, that doesn't help.

        Unfortunately my comments here won't help the situation you find yourself in but they might help someone to avoid a similar situation. I would say in the auction details that the site files, etc., will be put on a CD and posted to the buyer. This can be made to appear as if its a free extra. Send the CD via a tracked mail service so there is proof of delivery for PayPal and whoever else might become involved if there is a dispute.

        If, as in this case, there is no address information on file with PayPal then ask the buyer to provide it. If they won't then I would cancel the sale.

        Obviously there would be no transfer of domain names or anything else until the buyer has received the CD.

        Using an escrow service is better than the above but for small amounts of money escrow can be a bit expensive.

          I can handle it, if your cool with your sites and profiles being defunct when im finished , lemme know.

          i can have the site deindexed and the profiles banned in less than a week-permanantly.

      Whats amazing is that people will pay $29 to sell a site (potentially one worth thousands of dollars) on Flippa even though they do absolutely nothing to see the transaction go through. I mean every freelance site that lets you hire a $20 designer to make a button has a escrow service. Heck even Fiverr handles the money for you. But Flippa has no interest in protecting there users, yet people still use them. That's just insane to me.

          I think one reason this situation makes me livid is that I gave a lot of free post sale support to the buyer because they seemed to be a polite older person.

          So I personally helped them set up everything and there is no access.

          The buyer has a solid social media presence and is quite vocal promoting the websites. (They're in the weight loss niche)

          I just can't believe he thinks he can make money off these sites while keeping them for free!

            Out him on the same social media he uses and keep doing it until it embarrasses him enough. Use escrow from here on out to help protect yourself against scumbags like this.

        I've been hoping and wishing that at least one or two competitors would have taken off by now.
        Vexes me no end.

      I have all his info. I think he thinks he's untouchable because we're on opposite sides of the globe.
      But there are debt collectors everywhere. I'm probably retaining a lawyer in his city if he doesn't respond to personal calls.

    Contact domain registrar, hosting company, provide proof of charge back and that the buyer did in-fact not "purchase" your domain...means (in my opinion) he is not entitled to keep the domain. I would try that.

      I agree with this advice. I would also contact Paypal (or whoever the payment processor was) and prove that he did receive what he bought by showing them the domain registration information with his name on it.

      I was just about to post this same suggestion. This is your best chance at getting this resolved in your favor. In the future, use Escrow.com.

    Did you sell him the website content along with the domain(s). If so, file a DMCA with his host, even if it is offshore and provide the proof that you owned the site and domain and that he filed a chargeback. If the host honors DMCAs, they will take down the site.
