I wonder if it is legal to refer my brother to Hostgator and earn a commission for his sign up? Isn't this agains their affiliate TOS? - I mean to refer family members. He will be signing up from the same IP address that I use.

Just ask customer service, I don't see how it would be against tos, and how would they even know it's your brother

You should be fine if he has a separate account. Even if it was on the same account, you just wouldn't get your commission.

yeah that should be alright. Besides how would they even know unless you are both using the same payment account otherwise it should be fine.

I don't think it is against their TOS

Some merchants allow this, some not. Check out their affiliate terms and you will see. I understand nobody likes to read these long documents, but you can simply use CTRL + F and search for words like "relatives".

Yes asking support is a better way because they will tell you the surest thing before you even spend time and energy.

This does violate their TOS: Web Hosting Services, Reseller Hosting, VPS Hosting, and Dedicated Servers by HostGator

No commission will be paid for signups by you, your household, or anyone within your organization.

There are very few affiliate programs that are going to pay out signups coming from the same IP address. That's a surefire way to kill profits.

Um...why not just use the same hosting account for both of you? (if you have something costlier than the Hatchling)

They have stated it clearly they don't give commissions on sign ups by your family members, but if you can manage to hide it by using different IP you can get your commission.
