Hello,

I am from Albania, I am an Albanian citizen.

The affiliate networks I am registered on have a form for their affiliates to fill for tax purposes, but they say that it needs to be filled only by the US residents.

I have never been in USA, even though I had a VISA which expired on April 2013, but unfortunately I didn't visit USA.

Question: Are the affiliate earning considered US income? Should I declare them to the IRS?

Also, another way I make money is by being payed for online services I provide to individuals or companies that send me the payments by PayPal.

    You definitely need to direct this question to someone qualified to answer to it. You need to direct it to an accountant or possibly a tax attorney. If you start receiving other answers on here remember none of us are actually qualified to answer this question.

      Hi Tony, Sorry I know its a bit of an old thread and maybe you already found he answer by now (or maybe not?)

      Anyway here is my 2 cents:

      A Tax treaty is a form of agreement between 2 countries to stop "double taxing"...meaning that the individual is being taxed in his own country as well as foreign country..which means he is paying too much tax/unfairly!..the tax treaty helps to reduce this amount significantly.

      USA has tax treaties with many countries...but USA does not have a tax treaty with albania:
      Countries with and without Income Tax Treaties with the U.S. – South Florida – Tax – Asset Protection – Attorney – Broward County – Pompano Beach – Corporate – Lawyer – Estate Planning – Tru

      this means, you would be getting charged complete tax in both countries unless you do something about it.

      if there "WAS" a tax treaty, you would need to apply for a TIN (Tax Identification Number) which could be an ITIN or an EIN in USA.

      However since albania/usa doesnt have such traety, the usual method is to sign a w-8 form with the IRS USA...which is basically an "exemption" from taxes in USA....but thats a simplified explanation..since there are many different kind of w-8 forms..

      some of them dont give a complete exemption...but a big reduction in the amount withheld.

      as for the affiliate network...some of them will simply require a w-8 form and then release all money to you, while others like amazon will with-hold 30% of your earnings.

      in short, you don't need to file for taxes in USA, find the w-8 form provided (usually by the affiliate nework itself) or otherwise contact IRS, they will help you with the right form...

      its like this: imagine you sell something on ebay from your country, and you shipped/exported it to a client in USA.....do you need to pay taxes in USA? no....right?.....same thing applies for affiliate networks.

      As long as you are "residing" elsewhere (anywhere but USA)....

    yeah, I agree fairgo advice, maybe you can provide W-8 to send US affiliate marketing AM..I think you can pass their review...

    well the usa will have a hard time enforcing a tax on you, that you are not a usa citizen

      Thanks a lot for your comments guys.
      Yeah, in fact I have discussed this matter with some specialists of the field and they said that I don't have to pay any tax in USA at all, because I am not a resident of the USA and also I am not staying there more than 162 days (if I am not wrong per year. So this is enough for me. I just complete the forms that the affiliate networks provide and that's it.
