E-book rights and contracts when hiring a author

I am started a webpage to market a few affiliate products on. For the first time ever I am hiring a author to write a ebook for me that i am going to give away to everyone who opts in on my new page.

My questions are as follows.

1. What type of contracts do i need with the author so they can not sell the book to other people? So they don't sell me copyrighted material? and is there anywhere i can download a genric contract for this that I can modify?

2. What type of contracts, or terms and conditions do I need to have for the downloader who opts into my mailing list and receives the ebook as a free download? So they can not legally resell the book and information?

    Good Questions,

    Well for one thing, if you expect to use a contract you should also expect to pay more for the service that you are getting.

    Many service providers will provide a basic service without a contract.

    However if you want to institute a contract expect to triple your actual cost for hiring that same provider, many people fail to realize that this has a direct effect on the price for the service being provided.

    I have seen some buyers that expected to have a contract signed and returned in the mail, on a very low quote, needless to say before most providers will go to the trouble of signing and returning a contract in the mail, your cost will reflect the amount of service you are getting.

    Ok, I already told the writer they must sign a contract for the e-book. I really need to know where to get a good contract online for e-books so I have everything covered.

    Anyone have any ideas on where I can get a template to edit and use for my project?

    Now, I say this with a certain amount of trepidation, but here is one example,

    Example mind you, it may not be right for your circumstances.

    I would advise against using a generic contract, without first getting some advice from a qualified attorney.

    but likely you will not do that, and if that indeed is the case I would recommend that you run this by no less then two of your closest friends.

      Thank you for the sample contract. I do have a attorney friend who will go over it with me and help me convert it to fit my needs but its always good to have a start since I am not paying for the help.

      My next questions is once my e-book is created and available dor download online what kind of protection can I have so people are not allowed to sell the book or present it as their own on a alternative website?

        Honestly... I don't think there is much you, personally, can do about it. Of course, the usual copyright protection laws apply - so, if you find out that somebody stole your product you can report it to their host (and/or domain registrar), send letters etc.

        It is relatively easy to deal with this kind of obvious copyright infringement; it is much more difficult to deal with those that take your content, "spin" it a little bit and present it as a 'new' product of their own.

        Hi, just got back online,

        Yes there are some things you can do, however, none of them are 100 percent, There is the argument that if Microsoft cannot protect their own products how can you?

        Which I reject, but for the most part it is true,

        A lock is only for those that would not take something normally for those that would take it anyway there is not much you can do.

        I have a custom made system that I developed for my own use, so it is really not available on the open market,

        There are some other options, which do not really fit in well with what you want to do, I would say a lot would depend on what your product actually is and how unique and centered the product is.
