EzineArticles.com: Are you IN or OUT of compliance?

I received an e-mail from an IM'er earlier this evening describing his revenue model. One of the key components of his strategy is to collect and publish articles from the EzineArticles directory, to the tune of 10 articles a day, 7 days a week.

I tried to explain to him that he was in violation of their TOS, since EZA limits the number of articles you may republish to 25 articles in TOTAL per calendar year.

Some people likely don't read the TOS and act based on what they hear others say. There is probably an assumption among many IM'ers that they are free to republish as many articles as they like from EZA. In fact, that's not so. From the TOS:

a. Agree to limit the number of articles reprinted to no greater than taking 25 articles from our site per calendar year per unique domain that you own. In addition, for domain owners of many domains, you may not reprint more than 250 articles per year (10 sites x 25 articles reprinted per domain).

And another one that some folks may not be aware of:

c. Agree to not use any content from our site in audio or video derivatives whatsoever.

so that means you cannot use an article from EZA as the basis of an audio or video presentation.

    Ah, yes, 'Terms of Service'.

    It's nice to know somebody reads them but you have missed the 'great escape' - publishing an article on the web is not accepted as 'reprinting' - also, do you think EZA are going to go up against their authors if the authors are content to see the returns from their articles maximised by having their signature box constantly exposed?

      Not accepted by whom? Reuse of articles in Web sites and other media is commonly referred to as "reprinting".

      In any case, I never, ever take any articles from EZA for reprinting. There are other sites that are better options.

    He could just contact the authors directly and ask to use their content on his site provided he has a resource box (link) back to their website.

    I don't know any author who would turn down having their content published on other websites as long as they were receiving credit for their work and the sites were in good taste.

    Plus, I don't know how legal EZA's terms are in that instance. The article does not belong to EZA, it belongs to the author. It's simply a gambit meant to ward off competition or weakened content authority due to duplication.

    I'm pretty sure the reason for item a. mentioned in the OP is because EZA does not want someone creating their own article directory based solely on EZA articles and that's understandable.

    But, as Michael Taylor alluded to, I'm not sure what action EZA could take for violators of this as long as someone is not creating an article directory and as long as they are leaving the article intact including the resource box. The only recourse for EZA that I can think of would be to ask the offender's hosting company to shut down the site and I'm not sure any hosting companies would take this action based on this violation alone.

    And since many articles are already syndicated to other esites... I doubt that Ezines could really prove that ALL the articles came direct from Ezines.

    I know my articles are already showing up on other articles sites. Whose to say that the article didn't come from there or from the author direct or from someone who was authorized by the writer or in any manner of otherwise legal reprinting.

    So, I guess it's just to have a protection: we said you couldn't. But in practice, if you have 26 or 260 articles, I doubt they will bother.

      I think you're exactly correct. In life you can be respectful of others who provide a service such as EZA's or you can just exploit it and ignore their rules. In the end you probably will never suffer any consequences of ignoring their requirements.

        I've only published a handful of ezinearticles ever and only did so because the content was so good I wanted it on my sites.

        If you wanted to remain ethical in your agreements (which I think should be the goal), many times you can find the same article on other article directories which don't have limits on how many you can publish in one year's time. So once you hit the 250 in ezinearticles, there are still thousands you can publish from other places.
