Elance: Ghostwriting and Legal Terms

Disclaimer: In this thread, I am NOT asking for ANY legal advice whatsoever. I'm inquiring previous Clients who hired Contractors as ghostwriters on whether they have found any answers online to similar question(s) as mine. Thanks for your help!

Hey guys,

In terms of hiring a ghostwriter for an eBook, I know that Elance contract is supposed to label this work as "Work for hire", therefore giving ALL the intellectual property rights to the Client (here: https://www.elance.com/p/legal/servi...contractor.pdf)

However, I also found this (see the 2nd answer by Bruce): Who owns the copyright of work created thru Elance? Also, am I protected from unemployment claims by hiring someone thru them? - Avvo.com

^ What's your opinion on this?

Has anybody done any research on this particular subject, have any good links I should check out and possibly some good contract templates for hiring a ghostwriter that you use? I found a few, but I'm wondering if there's anything better.

No need to give me any actual legal advice, blablabla and other legal disclaimer BS.

    It really depends on what state/country you are in. Different laws are different from country to country.

    Are you in the United states?

      put it in your job description that you will own all the rights, you can also get a contract signed

      Yeah, I'm in California. Does it matter which state is the Contractor in, and if so, which one supersedes? Do you know by any chance?
