Texting vs. email marketing

I understand that you can get blacklisted for sending too many emails to potential clients,
what about texting marketing messages to potential clients? Is there some kind of blacklist or ban penalties? I'm considering sending out maybe one hundred texts per month, approx.

    100 texts a month would probably be worthless .. what are you going to get 1-2 sales per month if that?

    Texting will also have limits both by regulation as well as the carrier. And if you get reported then you will have another nightmare.

    Deliver value to your email list and you will not have the issues of getting reported as spam

    You are not allowed to send out unsolicited promotional text messages. What's more if a person has "do not disturb" activated from his carrier, your messages won't get delivered and even if they do in some case you'll end up deep trouble.

    And, unwanted texts amount to spam messages, much like spam messages in an email. Even if the person doesn't report it, they won't act on it as that is a cold lead, not even qualified for what you are offering. And, even if you bought a list of text leads from someone who claimed all those people had previously bought a service or product similar to yours, they still might not respond as they had not personally contacted you about what you are offering. So they would be wondering what you were doing texting them or how you got the number.

    Texts without prior written consent can constitute one or more violations of the Telephone Consumer Protection Act. Statutory damages of $1,500 per violation would be applicable meaning that the plaintiff would not have to show any actual damage. Multiply that $1,500 by the number of texts sent and you're in for some trouble. Same goes for the use of prerecorded messages to residential telephone numbers or cells.
