The Death Of Affiliate Marketing - First NY, then NC, and CT...who's next in line?

Amazon.com is located in Seattle, WA.

I am located in North Carolina.

Customer A, who just clicked my affiliate link, is also located in North Carolina.

Guess what...if the Senate has their way, Amazon would be required to collect NC sales taxes for the purchase that Customer A makes through my affiliate link!

(Read that again to see why that is crazy)

Connecticut also has File No. 599:

"AN ACT CONCERNING THE DEFINITION OF "RETAILER" FOR PURPOSES OF THE SALES AND USE TAX"


As someone who owns a retail store...anytime you are required to collect taxes - you are required to create the paperwork to show why the taxes were collected.

Can you imagine the workload this puts on a company like Amazon.com who generate 15% of all their sales from affiliates!

Not to mention the unconstitutional provisions of these laws:

What right does the State of North Carolina have to require a retailer in the State of Washington to collect taxes for them?

How does a link referral from a resident of another state qualify as a RETAILER!?



So, instead of cutting government spending...their going to axe your affiliate commissions.

Shame.

    Maybe it will create a niche industry creating offshore limited companies for affiliate marketers. Come to think of it, someone could create an offshore company and "host" your affiliate id and act as a pass-through for a small fee. Then all your income would be from outside the US. Hmmm... may be an opportunity here.

    Why don't they collect it themselves??

    Is it because they can't?

    Don't they get enough from you paying your state taxes?

    (I'm sure you pay more state taxes than the average tarheel)

    How much to they want in percentage?

    I guess you can't call this "taxation without representation", can you?

    I'm in NC too near Raleigh and many small business organizations are in high gear to lobby the State to not pass this legislation. If you'd like some links just PM me and I'll pass them on - but folks like NCTA and others are here to help us SMBs.

    I think the whole internet taxing idea is politically motivated... 'See voters, I'm doing something, I can't help that my idea got shot down'.

    As creative as internet marketers are, 'if' there is a tax levied, a solution will be found and govt will be left twiddling their thumbs, trying to catch up again.
