Do you need to put privacy policy & terms & conditions or TOS on mobile websites?

Is it legally necessary to put privacy policy, terms and conditions or tos on mobile websites that we create for business owners?

I have purchased a couple of mobile website templates from a couple of WSO's and I don't think that the samples that they have included a privacy policy and terms & conditions on them.

If they are necessary, where can I buy the privacy policy & terms and conditions template?

I'm no lawyer, but I would say that a terms & conditions is really only necessary if your website collects information from a user. Things like email, phone number... name even I'd suppose.

Having said that, depending on the type of template you purchased, you may not need one (again, back to the function).

Furthermore, to add a privacy policy and a terms and conditions page you could really go one of two ways: you could make it really tiny font and stick it in the footer of each page, if the themes you have are JQuery Mobile based you could make it collapsable to take up less space. Then finally, you could create a whole seperate page (dupliate the HTML of one page then just change inside the [BODY] tags (probably within a paragraph tag) and add both. Then add a link elsewhere.

I'm working on some mobile templates myself so it's good to know people would like to see elements like this included.

Let me know if I can help you incorporate a PP or T&C into a template of yours.

Thank you so much for your post. I really appreciate it.

I thought that regardless of whether or not we have an opt-in page on our websites, we are still required to have a privacy policy, especially because we track with google analytics.

Please correct me if I'm wrong.

You are correct. Most Google services require that you have a privacy policy disclosing that you track, collect, etc information about their service on your site. Basically the rule of thumb (as I understand it) is that analytic services in general, because they collect personally identifiable information, require a privacy policy.

Other examples of when you'd need a privacy policy include:
  • If your site uses Google Adsense (or some other form of contextual advertising)
  • If your site processes credit card transactions (merchant agreement)
  • If your site is targeted towards children (under 13 I believe)

That list could go on and on.

Make sure you get the TOS correct ...the best way in my view is to others and Copt the best
