    GRANTED I haven't been following this case, BUT.....

    A lower court ruled in 2013 that Apple conspired with publishers to sell e-books at a much higher price than online retailer Amazon.com. But Apple is appealing the decision in New York’s U.S. Court of Appeals Second Circuit.
    If they are trying to sell books at a higher price, SO WHAT? These days, there are SO many options, and Amazon depends on people that are more interested in OTHER forms of payment. Just yesterday, I bought a book for .99 and another for 2.99 and I earlier got some for 0. If the government wants to fight anything regarding ebooks, how about ones that are graphical and/or proprietary? And aren't proprietary some of the most expensive? I mean QUICK! WHICH is cheaper? $0(prop,graph) or $9(open,type)? Well a $9(open.type) costs an average of $9, and lists can easily be used. A $0(prop,graph) may require you to buy a device costing $99 or more, and the lists CAN'T be easily used.

    Regarding proprietary, LUCKILY, MOST at least mostly provide a free program to run on other computers, but that can change in a heartbeat. Suppose amazon decides to get out of the business(it has happened before), and the technology changes overnight(it has happened before). The NEARLY open becomes problematic. Even those that got the REAL device may be locked out. Such things won't happen with TRULY open ebooks.
