Deferring Copyright Infringement - Any Insights?

Hi Guys,

How do companies like Soundcloud or YouTube defer copyright infringement lawsuits when their users upload copyrighted material? I know they have measures in place to quickly remove such content, but how do they defer the liability from a legal standpoint?

I ask because I am about to launch a website that allows end users to upload their own music. At first, I planned to manually approve all new uploads but have decided that this is not only an inconvenience to me but also my users. I'd rather just auto approve all uploads and implement a measure to allow users to report copyrighted material and investigate those claims. Any insight is appreciated.

I'd strongly recommend asking an attorney. My (uneducated) understanding is that what you're proposing should fly, since you obviously can't control what your membership uploads, but again, I am not a lawyer.

It's bad law that *allows* this type of mass piracy in the first place. The sites hide behind so-called public disclaimers.
