    Thanks Mike - I was just making a decision about list building and that piece of info helped a lot.

    I'm starting to feel that there has to be an alternative to email that will be just as effective. Being reported for spam by opt-ins is irritating enough -but if it's going to get dangerous to market via email, we should be thinking of the best alternatives.

      It's yet another reason why the ideal marketing situation is where people proactively come out to you instead of passively waiting to receive your messages.

    Yeah, I guess this means everyone has to determine the person's age, etc.... as well. That USED to be required with getting personal info only.

    And there USED to be MINOR, and demographics. COPPA included below 13. NOW, it might be a good idea to get month/year or something similar.

    They HAVE spoken about not advertising to real young kids. I could see them passing a law for THAT! "OH, he's only 5, I can't advertise any toys or treats!"!

    I don't like email marketing for the risks involved when email recipients forget they did the required opt-in and all they have to do is opt-out. I've been trying to think of some better alternatives, but haven't come up with any yet. I think I'll go read Mike's new rules.

      Some years back when spam was really bad ... people devised all
      kinds of ways to overcome these issues.

      Both Allen and our former MOD Paul Myers came up with widgets
      which would put up an Alert discretely in subscribers browser
      windows.

      As any child or idiot can check the box in COPPA registrations, there
      is little that can be done in reality about underage subscribers.
      Maybe, you could make a nominal one-off CCard charge (£1?)
      payable to a charity or dropdown list of charities for subscribers ???

      Maybe you could TWEET or use one of the newer verified sender
      email/list providers .... dunno.

      Otherwise all you can do is be scrupulous, clean your lists,
      use double/triple optin, state your policy clearly and provide
      a prominent unsubscribe link onsite and in messages.

      There is no way can you provide a subscriber system that is
      safe against clever kids and/or anal adults ... thats a fact!

    The part that just slays me is that this article pretends that it is a new phenomena that Yahoo blocks legitimate (double-opt-in) business mail.

    HA HA HA. I must say 100 times per week for the past 3-4 YEARS that 'you didn't receive it because you use Yahoo Mail which is a JUNK account that blocks and loses business mail 50% of the time.'

    It is widely known it is one of the least marketer friendly. This is probably a COY WAY to mention Google Certified Mail since I for one never heard of it. I always do recommend Gmail though -

    Another thing that is just ludicrous - although I use Gmail and they are pretty good about putting spam in the spam folder and delivering mail to the inbox, there are times when we get so much mail in our new orders account that the two get switched.

    Therefore I am forced to look at the spam folder before flushing it. FOR YEARS NOW there IS A STEADY STREAM OF SPAM USING filthy, gross words in topics from perverts -

    HOW COME THIS **** GETS THROUGH at all???

    - WONDER HOW YOUR 13 YEAR OLDS LIKE THAT? Certainly less egregious than acne medicine? NOT.

    Most if not all the topcs either embarass me or gross me out - and I am alot older than 13. That is just tuff - no acne medicine but a **** extender to make her ***** jump for joy - now that is for the Girl Scouts alright.

    WHY THE HELL DON'T THEY ENFORCE AND PROSECUTE THE LAWS THEY ALREADY HAVE? WHAT A BUNCH OF DORKS ARE IN CHARGE. BUSINESS AS USUAL.
