The Bitter Truth of the Chocolate Conspiracy

Canada is investigating a number of high-profile chocolate giants for allegedly trying to cut themselves a sweet deal through price-fixing in the multi-trillion dollar chocolate industry. This conspiracy, run by a powerful dark and sinister group known as the Chocalistas, will make bank fraud look like a picnic.

Canada's Competition Bureau served search warrants on several major bar makers this week requiring them to turn over reams of documents on their pricing arrangements.

Regulators are probing alleged price-fixing by affiliates of Nestle, Cadbury, Hershey, Mars and others, according to media reports.

"The bureau is investigating alleged anti-competitive practices in the chocolate confectionery industry," Marilyne Nahum, spokeswoman for Competition Bureau.

"The Superior Court of Ontario has granted search warrants based on evidence that there are reasonable grounds to believe that a number of suppliers in the chocolate confectionery industry have engaged in activities contrary to the conspiracy provisions of the Competition Act," she said.

And just last week, the German Federal Cartel Office raided the offices of seven of leading chocolate companies including Mars Inc., Kraft Foods Inc. and Nestle SA searching for documents. Three months ago, Canada's Competition Bureau searched the offices of several companies, many of the same ones as in Germany.

The Canadian investigation sparked several American lawsuits accusing the world's biggest chocolate companies of violating antitrust laws.

The U.S. Department of Justice declined to confirm it is investigating, yet several companies confirmed receiving inquiries.

The cases detail how informants kept letters for years, showing that Canadian executives exchanged confidential pricing information dating back to 2002 through e-mail, phone and meetings.

Marilyne Nahum, a spokeswoman for the Competition Bureau, declined to discuss the details of the ongoing investigation. The companies could face criminal conspiracy charges, which carry penalties of up to $10 million Canadian dollars and/or five years in prison.

According to affidavits submitted in an Ontario court to obtain search warrants, top executives at Hershey Co., Mars and Nestle met secretly in coffee shops, restaurants and conventions to set prices. The volume of commerce involved is potentially in the billions of dollars per year.

The German Cartel Office has said it suspected the companies had conspired with one another to raise their prices even higher than the increase in the price of raw materials, such as cocoa and nuts, would have demanded. If the office finds evidence of collaboration, the companies face possible fines of up to 10 percent of their annual income.

Mars North America was contacted in early December by the U.S. Justice Department about a preliminary inquiry concerning pricing practices in the U.S. chocolate confectionery industry, said spokeswoman Alice Nathanson.

She also confirmed German officials visited the company's offices in Viersen last week. In Canada, Mars continues to cooperate the Canadian Competition Bureau's investigation.

Edie Burge, a spokeswoman for Nestle USA, said the company "is aware of a preliminary investigation into marketing practices in the U.S. chocolate industry being conducted by the Department of Justice," and will cooperate with any investigation, but has not been contacted.

A New Jersey confectionery company filed the first lawsuit in late December, charging price fixing by an international cartel of companies -- Hershey and Mars, the leading chocolate companies in the U.S., along with other companies such as Nestle and Cadbury Schweppes PLC.

The confectioners claim that a chocolate cartel raised prices three times since 2003 are planning another hike for 2009.

    Chocolate? Okay yeah, Now they have definitely gone too far. How stupid can these corporate elite be to mess with a chocolate addicted female population?

    Hey - does the male population foresee their wallets bleeding as they try to provide the sanctified chocolate enzymes to their women for their monthly PMS relief? What kind of cold blooded, deranged, sadistic person would do such a thing? What happens if little Johnny needs glasses or little Suzzie needs electrolysis and daddy can't swing the price of mommy's chocolate?

      Damn chocolate cartels. They rule the earth. Ever noticed the increase in the sizes of the buttocks lately? This is not a coincidence. :-( There's a reason for bigger buttocks and those who know the truth, well..... let's just say they are not sheeple.

      The stupid Canadian Competition Bureau will investigate chocolate price-fixing (which frankly doesn't cost us much anyway - I buy lots of chocolate and it has never been a burdensome amount of money) but they steadfastly refuse to investigate the very obvious price-fixing on gasoline that goes on here in Canada???

      When oil prices go up, the price of gasoline immediately and sharply increases. "Oh, prices at the pump MUST reflect oil prices, as that is the major constituent of its cost." When oil prices plummet (like from $140 to $70/bbl) gas prices...remain the same. "Oh, it's very complicated - there is distribution, and inventories, and refining costs, and taxes - prices can't fall just because oil prices have collapsed..."

      Where I live, if one station decides to raise their prices, ALL the other stations raise their prices too. How is that not collusion? How come they aren't trying to compete with each other?

      In case you are wondering, I paid $1.34/liter for gasoline today (that's about $5/US gallon).

      Meanwhile, I can buy a pound of cocoa for about $3, and that lasts me months. But THAT is where the unfair pricing practices are???

      Grrrr.

      I am going to go eat some chocolate now and try to forget about all this.

        Gasoline? Who cares about gasoline? Can you melt gasoline and pour it over ice cream? Can you break gasoline up and bake it in cookies? Can you let a piece of gasoline slowly melt on your tongue and feel the richness coat your tastebuds?

        Gasoline doesn't even come close to chocolate. Gasoline isn't fit to lick the boots of a fine piece of dark chocolate.

        Of course, if we're talking milk chocolate or that grainy crap the Yanks and Brits make, that's only fit for feeding to the lower life forms - like little kids and people who voluntarily live in Oregon.

While my more civilized and principled intellect tells me we must boycott these industries until they buckle and break their monopolies - my animal nature has now been stirred and I am having a terrible battle with myself. I feel I MUST BAKE CHOCOLATE COOKIES topped with a generous layer of HOMEMADE FUDGE. How can I go on through my day without the taste of these succulent treasures permeating my tastebuds?

            Antitrust Study of Price Fixing by Big Chocolate Conspiracy

            A number of retail grocery stores have filed suit against Big Chocolate for alleged price-fixing conspiracy, adding to an already large number of suits that have been filed since US and Canadian government investigations into alleged price fixing of chocolate was revealed. The industry is controlled by a cartel known as the Chocalistas - operating on the dark side of Big Chocolate.

            Retailers filing suit against Big Chocolate include Safeway, Kroger, Walgreen, Hy-Vee, Meijer, Publix, CVS, Rite Aid, Food Lion, Kash N' Karry, Hannaford Bros. (which itself became the subject of numerous recent lawsuits because of a data security breach).

            Investigations have been launched by Canada, the U.S., and Germany known as the Giant Eagle Chocolate coalition. The Giant Eagle complaint alleges a number of facts taken from documents filed in a Canadian government investigation, including statements by unnamed cooperating witnesses about secret meetings and communications between chocolate makers. The complaint states that the party cooperating with the coalition is believed to be Cadbury.

            Without the factual allegations from the unnamed sources, the complaint would be unlikely to survive a motion to dismiss under the Twombly pleading standard. Other than the allegations from the coalition investigation, the complaint includes allegations such as the industry being "ripe for collusion" because: the industry is highly-concentrated; there are high barriers to entry; the product is an undifferentiated commodity; and the industry is facing increasing demand by women with PMS and profits generated by claims of cardiovascular benefits of consuming chocolate on a daily basis. The complaint also alleges that there were parallel price increases, and that the stated reasons for the price increases were conspiratorial linking to the Chocalistas.

            While many businesses focus on defensive litigation as their workers become increasingly obese, the Chocolate lobby in Washington DC heavily promotes the cardivascular health and physiological benefit of chocolate consumption. Bribery and corruption continue in the House and Senate as the Chocalistas continue their goal of global domination of dark chocolate.

              Oh. I see my "look over there" tactic er...suggestion didn't fully address this issue. Let me be more direct.

              On behalf of myself and all the other directors of the International Chocolate Cartel (ignore the name, we are changing it to "Happy Funtime Chocolate Lovers Producing Club"), I wish to state categorically, and for the record, that there is NO price fixing going on in the chocolate industry. It is a scurrilous and ridiculous charge.

              We meet daily and discuss exactly what prices all manufacturers will charge consumers for chocolate, in our diligent efforts to ensure consumer protection. The prices we collectively agree on are fair and for the good of the consumer.

              We know that we bear a great responsibility, as chocolate is a necessity for daily life. We take our responsibility seriously, and ensure that prices are set with only the consumer's best interests in mind.

              So, now that you know categorically that there is no silly "price fixing" nonsense occurring in the chocolate industry (the official position of the Cartel), you can go back to enjoying dark, creamy, delicious chocolate in bars, ice cream, cakes, cookies, drinks and all the other ways that our advertising suggests you use our product.

              For your own sakes, I now suggest that you cast your attention towards the evil gasoline industry if you are looking for price-fixing. Otherwise, there may be a shortage of essential chocolate in the near future...

    Read the book "Bitter Chocolate" by Carol Off - it discusses not only price fixing but the use of children as slaves in the Ivory Coast to produce cocoa for these big manufacturers. A very interesting and disturbing read.

      A Sad Day for the Children of Cocoa Farmers

      Yesterday, in a secret joint session with Big Chocolate, Senators and the Congress basically ratified the very limited efforts of the industry to combat child labor in the cocoa sector. So, for all practical purposes, the crucial part of the long-established 2001 Harkin-Engel protocol is ineffective, that the industry establish a "credible, mutually acceptable, voluntary, industry-wide standards of public certification, consistent with applicable federal law, that cocoa beans and their derivative products have been grown and/or processed without any of the worst forms of child labor" is dead.

      The system that is now in place and that will be completed by December, while "mutually acceptable" to the Chocalistas and the law makers, is definitely not "credible." It does not certify that "cocoa beans have been grown and/or processed without any of the worst forms of child labor." The system consists of surveys that document the extent of child labor in the Ivory Coast, Ghana and the Côte d'Ivoire and then verifies that the surveys are accurate. It also documents what is being done to deal with the problem - by anyone but Big Chocolate.

      It's almost ironic if it weren't so sad, but the system developed by the industry certifies that, yes, cocoa in West Africa is produced with the worst forms of child labor. Except now we know for sure. Children still handle chemical pesticides and fertilizer, they still use machetes to clear brush and open the pods, they still carry heavy loads that lead to stunted growth and other developmental problems and they still are not in school.

      There is at this time no expectation that the industry would develop a true certification system. Their responsibility, unfortunately, is only to their shareholders, not the children of cocoa farmers. The Congressional investigation certification scheme would just tell the industry to get back to work or else.

      It is clear that everyone involved, Big Chocolate, the politicians and the governments in Africa, and the Chocalistas, just want this issue to go away. Now they have achieved that goal. From now on, whenever someone raises the issue of child labor, they can point to their system. And when the critique continues, it can be dismissed as unreasonable. Business as usual. Enjoy your chocolate, brought to you by child slave labor and the evil Big Chocolate industry - the Chocalista conspirators.

        Ahhh, Jesus Christ, I saw "Willy Wonka" and thought this was just play.

        It's sad alright, but as long as there are major corporations everyone who is involved at the labor levels will be abused as they can get away with abusing them. That is all a corporation is when you strip it to the bare bones. About the time that these victims are saved, another corporation will infilter their locality with promises of "bettering the quality of life for all" and the workers will just be subject to more enslavement.
        In a world where corporations dominate, the worst sin of all is to be poor.

          Big Chocolate is investing $10 million in a 5-year research project to unlock the secrets of chocolate's genetic code. The chocolate cartel, or Chocalistas, will be using IBM computers in a secret alliance for putting its supercomputing powers to use in research that may one day help create better cocoa crops, by sequencing and analyzing the entire cocoa genome.

          The five-year project is ostensibly aimed at safeguarding the world's chocolate supply by dissecting the genome of the cocoa bean, and will analyze the more than 400 million parts of the cocoa genome. This is the first stage in developing cacao trees that can produce more, survive droughts, and combat disease and fungi. The next stage will be to breed genetically superior specimens to battle the foes that have shrunk the number of beans to make chocolate over the years. The cocoa harvest has become volatile and unreliable in recent years due to weather, civil unrest, and the unfavorable publicity of using child labor.

          Big Chocolate is conspiring with small chocolate and candy manufacturers in an industry-wide price-fixing scheme, to force prices artificially high to maintain the dark side of this lucrative multi-billion global market.

    The U.S. Chocolate Industry, through its Chocolate Manufacturers of America (CMA), and in collaboration with the Grocery Manufacturers Association, have petitioned the Food and Drug Association (FDA) to change the current requirements for chocolate.

    Their plan is to change the basic formula of chocolate in order to use vegetable fat substitutes in place of cocoa butter, and to use milk substitutes in the place of nutritionally superior milk. These changes will have adverse effects on the eating, physical and nutritional quality of chocolate.

    Cocoa and chocolate associations blame the Chocalistas for the global domination of large multinational manufacturers of fully processed chocolate products as a factor discouraging small producers from competing head-to-head in the chocolate bar or candy business.

    In 2008 there were no new producers of fully processed chocolate, because of low chocolate consumption despite the abundant stock of cacao beans. Cocoa butter and powder prices are artifcially inflated by the Chocalistas for countries in Europe and the United States at US$6,000 per ton. That price is far higher than the raw bean price of around $2,000 per ton.

    These radical attempte to dislodge the Chocalista stranglehold on the world supply and distribution of chocolate is expected to further reduce demand by introducing artifical chocolate for all major chocolate producers such as Mars, Hershey, and Cadbury.

      I'm glad you brought this up again Paul. Just last night, as in numerous previous nights, I stayed awake late thinking about the chocolate conspiracy. I want you to know, I'm not like all the other sheeple out there. I am following this story closely by going to the relative all knowing blog sites. InfoBars is the best. That guy really knows his chocolate bars conspiracy. His stomach tells no lies.

      You should be afraid, very afraid of what Big Chocolate conspiracies are doing worldwide to change the quality and taste of dark chocolate by the substitution of inferior ingredients. The global fight against Chocalistas is real, and the sheeple need to wake up and take action now before it's too late.

    Yea, not to mention all the refined sugar that gives cavities and makes teeth rot. They are in cahoots with dentists and the government's plans for population control. This is by having our teeth rot out and not being able to chew thereby dying from starvation and spending all our money at the dentist. This is so there's no money left to buy a blender to process food to a pulp and a straw to drink it. Not to mention no money for grub in the first place. Scoundrels.

      Just released: Instant Appeal Certified in Chocolate Price-Fixing Conspiracy Case

      The Chocolate Conspiracy Antitrust Case in court since 2002 will now proceed in full litigation. U.S. District Judge Christopher C. Conner of the Middle District of Pennsylvania was assigned to hear scores of suits filed against Hershey, Cadbury, Mars and Nestle, which together control 75 percent of the U.S. chocolate market. According to the law suits, chocolate manufacturers instituted three contemporaneous and nearly identical price increases and monitored pricing in both the United States and Canada.

      These law suits "describe a market ripe for collusion, punctuated by declining demand and product saturation," and that the plaintiffs "also detail significant interaction between similarly structured markets in the U.S. and Canada, where authorities have identified strong evidence of price fixing by Hershey, Mars, Nestle, and Cadbury"
