11 million dollar typo... a head shaker.

Hey all, this is a number of things at their finest. I can think of at
least a dozen jokes off the top of my head.

Summary:

English teacher/cheerleader (don't ask) sues a website for libel >> lawyer files lawsuit
against wrong website (enter the typo - like Bruce Lee) >> no one knows anything...
(shocking, huh?) >> judge rules against wrong website for failure to respond (enter
11 million dollars) >> mass confusion.

First, how many wives and husbands wish they could get 11 million dollars because
the other failed to respond? Don't answer, just another smartass Ken rhetorical
question.

Who has a clue in this story?

Additional musings:

1. Can the allegedly libelous website sue AP (Associated Press) for libel?

2. Can the cheerleader/English teacher (I said don't ask) sue the lawyer for
ineptitude, incompetence, or incontinence? (couldn't resist)

3. Can the wrongfully sued website counter-sue (not the waitress) for libel?

4. Can someone just please forward the 11 mil to my paypal and we'll call it
a day?

I hope you enjoy reading the story. It's like a small slice of heaven here in
the good ole US of A.

    It is COMMON for a defendant to get a judgement against them because they didn't respond/appear.

    APPARENTLY, in indiana, you have TEN days to respond. TEN!!!!!!!!

    I just got an application to assign me for jury duty. I had 10 days to respond. DID I respond in 10 days? I have NO idea! I told them my turn around time is about THIRTY days, and if they want me to respond sooner, they should send the form to my MA address!! As for the qualifications? They asked me if I ever worked for an insurance company. I HOPE that disqualifies me! I worked for MANY! I listed prudential, hancock, manulife, lincoln, swiss re, and even the NY DOMH!

    and they asked me if I had friends/family in law enforcement. I do. I HOPE that disqualifies me. And they asked if I could judge fairly. I said NO! If I am the only one not voting a certain way, I'll change my vote, since to do otherwise could REALLY hurt ME!

    I HOPE they don't call me. Alas, next month, I may find they told me 10 days earlier to appear ASAP!

    Only in America are the laws passed to protect the criminals, plus you can sue anybody for anything and if arrested, you're guilty until proven innocent. I don't care what they say. :-(

      YEAH, I have been saying that for DECADES!

      PEOPLE are considered guilty until proven NOT guilty. They never really say you are innocent.
      DRUGS are considered innocent until proven guilty!

      Do you realize that apparently FRANCE is the ONLY place that has codified innocent until proven guilty!?

    The dirty little secret in the American Criminal Justice system: You know how criminals are always "copping pleas" in "back-room plea deals"? No Defendant ever wrote a plea agreement. Plea bargains originate only from the Prosecutor's office.

    Hmmm. Who are the "backroom deal"-ers???

      I'm sure "law and order"(the TV series) is pretty true to life here. The prosecutor either knows of a bigger mark, and wants them, or the defendants attorney uses the facts he knows, or then gets from the defendant, and tries to get a deal. THEN the prosecutor tries to formalize it, and hopes all works out.

      The whole thing is a GAME though! They have 12 jurors and they ALL have to agree! So unless the prosecutors feel they can REALLY win, they may accept a lesser plea because that pretty much assures a conviction, because it doesn't even have to go to trial.

      That pretty much assures innocent people will be locked up. If a person feels they might be convicted, but they are innocent, they might go to trial to avoid 5 years, but maybe not risk the five if they can cop a plea for 1.

    It really depends on which story is correct.
    When I originally read it the story said the court clerk had put in thte wrong name.
    If that is correct,there would be no case against the AP for libel because there was no libel. The AP reported the facts as they believe them to be, and there would be no cause to think the court records were incorrect.
    Of course, under additional musings, number 4 is the only one that has merit, but it needs to be amended to forward 50% to Ken's paypal and the other 50% to mine..........
