Anyone out there buying new domain names and reselling them to other people???

Here is the question. As most of you know the ".co" domain extension came out in April 2010. I bought a bunch of businesses that have a ".com" and bought the ".co" and I am contacting them and offering to sell them the ".co".

One of these business contacting me and stated that they were not interested and stated that I should look at the Policies and Guidlelines for ICANN and reconsider the selling price.

I looked over the ICANN and found nothing that would cause a problem. Can anyone tell me if they know that they are talking about and IF anyone has had any luck in reselling domain names and especially the new ".co". What kinds of prices are you getting?

If you have a trademark name in the domain name the trademark owner can get the domain taken from you.

    This isn't legal advice...

Buying domain names under any extention and trying to sell them to businesses that are currently using that name for commerce can land you in hot water if a pattern can be established and somebody calls your hand on it.

It's a form of cybersquatting, and if you approach a company that has a registered Trademark that you have now registered as a .co, they can take it to the limit to teach you and others, by making an example of you, how the legal system works.

If they can also establish a pattern of your misuse of your domain registrations it won't be a happy ending for you. Many corporate lawyers are paid on a retainer basis and will be more than happy to exercise their duty to protect a Trademark as a matter of course.

You should consider the ramifications of trying to make money by registering other people's commerce identities before you send out any additional invitations for the purpose of making a profit. In other words, be very careful about the pattern you are establishing for yourself as a domain squatter. The downside can be huge.

There are several levels of Trademark protection afforded to businesses that use a given name for commerce.

It's foolsplay to assume that just because you can't find a Trademark for a given company that one doesn't exist.

Fwiw, what you are doing is not a sound business model anymore than sending out spam emails or other ways of taking advantage of systems set up for useful purposes.

Can you make some money doing this? Perhaps.

Is there a downside you haven't been fully exposed to yet? Most definitely.
