Should I get a refund ?

I live in New Zealand and often get my supplements from ebay in bulk as its much cheaper than local.

I ordered 1kg of creatine from a new supplier - it arrived with the USPS parcel ripped open and no contents.

It was sealed in a USPS bag with a stamp and sticker saying it was damaged by USPS in transit.

This was a $30 purchase including shipping.

Now I expect a full refund from the Ebay seller but they decided not to play ball - I escalated to a dispute on paypal and after that they offered to refund 50% which I refused.

I want a full refund. They used packaging inferior to the other sellers I have used who put stuff in a box or plastic container. These guys just put a bag in a card envelope.

Also as I understand on Ebay the seller accepts full responsibility until you receive the goods - which I have not.

What do you guys think - as merchants ?

    I am not a merchant, but we have set up Ebay accounts for clients.

    ABSOLUTELY, you should receive a refund. No question.

    If the UPS sticker is legit, should't UPS pay? BTW one of my pet peeves is idiots touching other people's food, like it is some paper weight or something. With respect to creatine, that means they should carry it from the bottom and if they violate the seal, make it APPEAR violated, or contaminate the area at the top, *****THEY OWE YOU A REFUND*****! After all, you are going to take that internally, and it should be treated as a FOOD!

    Wow, that is shocking that the seller wouldn't refund it right away. It is unethical and stupid, too, since Ebay shows users reputations.

    This was my understanding.

    I'm no lawyer but it seems perfectly clear to me that you're entitled to a refund. If the vendor chooses to pursue the matter of subrogation with UPS, that's his business? UPS was his subcontractor, not yours? He undertook to deliver the product to your address, I think? :confused:
