Paypal help - Can my sister do anything about this?

Hi guys,

wondered if you could help.

My sister's boyfriend sold something over ebay and the guy who bought it, bought it through paypal. The guy came to their house and picked the item up (which was £250). Now recently this guy disputed the transaction!!! Even though he came to the house, picked up the item and now has it. My sister had emails back and forth with paypal about this but despite what she said about him coming to the house, they reversed the money to the guy. Can she do anything about this? I know the money is back with the person now but is there anyway to get paypal to compensate in a situyation like this? She is calling them later today when she gets in from work. Was just wondering if anyone else had experienced something like this or knew what to do?


On another topic...I have a paypal issue. I bought a few items off ebay from Japan just before christmas. Anyway they were faulty so I sent them back. The person said they would refund me the amount plus the postage once they had received them. I sent recorded so I KNOW they have them and they told me they would get back to me on 5th Feb. They havent and arent going to pay (its 120 pounds altogether). Paypal says I cant do anything because it wasnt within 45 days and I tried a dipute within 60. I explained this to them through email and they told me they could do something but they then told me they cant and that I should continue to resolve it with the seller.

Can I do anything about this? Is it worth me calling paypal? I wouldnt want the expense of calling paypal if they arent able to help?

    I am sorry to hear about, as a previous merchant I am incensed to hear stories like this.

    Normally you cannot do anything about this, unless there is a proof of delivery to the registered PayPal address of the recipient. Even if there is proof of delivery, its is not valid unless it is to the registered address. A lot of merchants have been caught out by this.

    I wonder whether your sister has a signed receipt of goods from the scammer? If so, you may try your luck there but even then, I doubt you would succeed. I think the only thing you can do is to publicize your case so as to warn other sellers not to fall into the trap. If you know the person's address, the next step you can consider is to sue him through the small claims tribunal and report him to the police and see whether they will anything about it.

    Concerning your purchases from Japan, you can raise a chargeback against PayPal itself if the items were paid with credit card. However, you may well lose your PayPal account because of this.

      Thank you for your response.

      I feel really bad for my sister but I will ask if she has any proof etc to do something about it. I just can't believe the guy who came over and collected the item had a nerve to do this!!

      As for mine I think I paid by debit card so I cant do the chargeback..but can paypal do something about it even though its over there 45 day policy? Someone email from paypal suggested they could so I was wondering if its worth pursing or I should just give up?

    Sorry to hear about your issues - definitely not fun.

    As for your sister, in the US we have what's called a small claims court - usually for a small fee you can sue others that you feel have wronged you. The amount is usually capped, and while you can bring a lawyer, one is not needed.

    This also sounds like a case of fraud - if this happened here and we could not work it out I'd call the police and lodge a complaint. Maybe some tough love talk with show them the error of their ways.

    You also have to wonder - is it really worth your sister's Time? Things you have to answer for your self, but I would definitely let folks near and far know about this deadbeat at the very least.

    eBay has a fraud protection policy, I wonder whether you can check with them whether both of you are eligible for a claim under it?

    Unfortunately, PayPal only deals with non-receipt items. It does not deal with items that does it match its description, so I doubt they would find in your favour even it is under 45 days.

    Morover even if they did, they will not be able to recover your money if the seller does not have any money in his PayPal account. Therefore for large purchases, I always use pay via credit card through PayPal.

    I'd go after him in the Small Claims Court. The mere threat of that might make him give the item back, or the money as he know he'll lose the case.

    Just do a chargeback through your credit card if possible for your issue.

    For your sister, get a few buddies pay the guy a visit..

      I called PayPal when I needed help, and my experiences have been very favorable. (That said, my issues weren't related to refunds.)

      My best tip is to ask for the person's supervisor if you don't get the answer that you want. Sometimes, the person you first speak with is working from a prepared script. For unusual issues -- as both of yours are -- you'll probably need to speak with someone who has more authority.

      Even if your email to PayPal doesn't seem to get anywhere, a phone call may resolve the problem quickly.

      It may take a couple of calls, but it's certainly worth a try.

      I'd also contact eBay about the person who bought the item from your sister's boyfriend and then demanded a refund. That is a fraud issue, and -- as already suggested -- it should also be reported to your local police.

      Did you get a receipt of any kind from the guy who picked up the item? Is your street on any video surveillance system, to show his visit to the house? Did anyone else witness his visit? Any third-party proof of the transaction can help your case.

      You may have to let this go as a "lesson learned", but it's certainly worth calling PayPal in case they can help you.

        Thanks for all the advice. I might call paypal about my issue...I dont see the point telling ebay - the last time I tried to sort something out with them they just ignored me!

        My sister said her boyfriends been in contact with the guy who purchased and he reckons he didnt ask for this reverse. There is potential for him to pay it, otherwise I think my sister will do the small claims..she now has proof in email anyway.
