files not transferred to my new hosting company

hi everybody,

I am in need of some help-in July i have purchased a wordpress site and domain for $580. I am a newbie and thought this was a great deal as everything was set up and I received training videos and secrets as to how to get traffic to my site. There was one condition on the sale that owner will host site for 2 months thereafter I have an option to continue with hosting with him or I can get an alternative-I have chosen NO-NO-NO-NO-NO-NO-NO- and set up everything. When I contacted the owner to transferr the files to my new hosting, he became very lax in completing the transaction.

I started email him 20/09/12- it is now 10/10/12 and I still do not have anything! This is so frustrating as I do not know what too do in order to either get my money back or get this files-the only communication I have is via email(im in RSA and he is in Mexico)

can anybody assist me in what I need to do in order to get this resolved? I cannot lose all this money and nothing gets done with regards to the owner

    OK, I will NOT answer your poll. WHY? Because it is BIASED and VAGUE! You see, there is only ONE person on this planet that can/must properly understand the basics to provide a basis for this. And that, in this case, is YOU! I mean should there be "international rules and laws to govern car sales to protect consumer"? NO! NOT if you don't know that you should provide basic maintenance and give it gas.

    Of course, the seller SHOULD state such things. Maybe they did, and you didn't notice.

    There are perhaps 5 possibilities.....

    1. They own it, don't know about it, and never wanted to move it. SCAM.
    2. They DON'T own it, and can't move it. SCAM.
    3. They felt they could hide their ineptness 2 months to get the money. SCAM.
    4. They are having problems with your host. OK
    5. They are backlogged. OK

    SO your recourse ranges from sue to relax.

    Do you know enough to determine which it might be?

        It depends where you two are, your evidence, and the amount involved. Maybe a dispute on the card, or small claims court.

    It's not normally done by the host you are leaving, unless there was something specific in the deal you made.

    The new host will often import your site for free. Contact them.

        Then you have a dispute or FULL, and EXPENSIVE, law suit as options. Your chance of getting your money back is LOW in a lawsuit!

            I feel very sorry for you - you may have been very unlucky, here, through inexperience.

            For the record, you've made a dreadful choice of new host (so dreadful that this forum won't even print their name?). If you can resolve this, at least go to a proper host who'll import the site for you, as Lloyd and Dennis suggest above.

    I agree with you op. It does sound like a scam. Not sure what else you could do though. Maybe a small claims court like one poster mentioned.

    Best of luck and I sure hope this isn't a scam. But sure looks and sounds like one.

    Like Lloyd said, just choose a new host that will import the site for you. A lot of them will do it for no extra charge.

      I would ask your web host if they can transfer it. If they tell you no, I'd suggest finding another web host. Since you have access to the site, you can also copy down the files locally or use a backup plugin if it's Wordpress.
