Are there any other photo processing places similar?

But it's so blatantly "we have a right to do anything we want to do - so suck on it", I was just amazed...and glad I don't use Walmart to process photos

I will certainly read the T&C from the next place I do though...:p

I heard Kim Komando today. She said something utterly @#$%^&*!!!!!!!

She said you can TRUST cloud drives, because they aren't as they were. They are not small geek run companies, but LARGE business man run companies with STOCK!!!!!!!

In other words, you can TRUST google because it isn't like google! Unlike google, google won't use your information in any way.

Unlike companies like JCPENNY, they are secure!

Unlike companies like WAMU, they WON'T go bankrupt and cause trouble for you.

Unlike companies like network solutions or godaddy, they will NOT trash your data if you aren't paid up.

And WHY? Because they are big and have stockholders(like all those above) and trusted employees(like all those above THOUGHT they did)

Let me make this clear! Companies can NOT necessarily be trusted. They may have a lack of security, use data, and may even have dishonest employees!

The only thing I buy from Walmart is ammunition, and I'm pretty sure my bullets set their own TOS, regardless of where they were purchased.

As for pics? Na.. I use my printer and my photo paper.

Faster, more convenient, and no shady terms to agree with.

I haven't checked lately. Is walmart still selling ammunition? For a time, a rumor, that was in part STARTED and CONFIRMED by walmart but at times DENIED by walmart, said they STOPPED!

I shudder to think of how many of these agreements (online) I've just clicked the check box on without reading what the hell was inside. I've never used Walmart's photo service though.

I don't shop Wal Mart for anything, just a moral decision on my part, but I am serious that almost everybody online and off are trying to slip things like that in.
Of course they do it because the majority of people are trained to just sign without reading and will just do it.

Glad I don't have a camera - digital for me only from now on.

You don't have to just read T&C online, though - you need to get a screen shot of them at the time you register or make your transaction. One of the tricks these companies use it to change them later and then hold you to the new agreement retroactively. I'm pretty sure they can't legally do whatever they want and make you adhere to it just because they changed their terms unless they have duly notified you in X amount of time beforehand, but you have ti be able to prove what the terms were in the first place.

There are SUPPOSED to be like 3 or 4 laws governing contracts!

ONE is supposed to be that you are made aware of it.
Another is that it is conscionable, meaning that you get a reasonable consideration for making it!

ALAS, too many contracts are NOT like this. MANY contracts contain a clause that they will be updated, and that WOULD be reasonable if the above two considerations were part of it. Acquiring use of your photos, for FREE, by developing using a service that YOU paid for is CLEARLY unconscionable!

They are still restocking & selling.

Just limiting purchases to 3 boxes per day per customer, and even then they can't really keep anything on the shelves for long.

Demand is higher than the supply lately.

It's ok tho. I can just send my wife/mother-in-law/father-in-law/etc. once I've hit my limit.

I don't know about the Canadian web site where that's from, but here's from Walmart.com:
WALMART.COM claims no ownership rights to the photos, photo files, albums, projects, captions or prints, (collectively defined as "Content"), that you place in your Walmart Digital Photo Center Account. However, by uploading Content into your Walmart Digital Photo Center Account, you agree to waive all moral rights to those images. In addition, you grant to WALMART.COM a nonexclusive, worldwide, royalty-free license, so we can download, upload, copy, print, display, reproduce, modify, publish, post, transmit and distribute the photos included in your Photo Center Account for the purpose of displaying Content to the people you select and to fulfill orders.

We will not use or modify your Content for marketing purposes or any other purposes without obtaining your express permission.

This is SO ambiguous! The statement "you agree to waive all moral rights" says LOT! ******MORAL****** rights! So they ACKNOWLEDGE that asking this of you is IMmoral! They LATER claim this is only for YOUR account, and your wishes. So WHICH is it?

I don't like Walmart, but I don't think the T&C is as bad as it seems. Mojojuju pointed out one thing and then there's the sentence before what MMM highlighted: "For all materials you use or allow others to use... ". In other words, I doubt they are going to start an IStockphotos type business from photos people don't want others to use.

Sounds like the same policy Facebook has. Once you upload a pic to them, they can use it in marketing. Those stupid "notices" people posted all over their timelines a few months back are worthless.

    Always read the license agreement.

I'm 100% positive that Walmart is not going to use your personal photos for any other purpose than what you intend. They probably use all of that legalese to protect them from ridiculous lawsuits. Most of you probably don't look like models or movie stars and thus don't have to worry about your faces appearing on a billboard any time soon.:p

      mojojuju,

      I beg your pardon..............

I AM a model and an actor....

Like 90% of the world...

It seems like almost everyone is claiming to be a model and/or an actor these days....

      Makes me laugh........

What a coincidence, I'm a model too. You've probably seen me in ads for watches, rings, and leather driving gloves. Yep, that's me.
