Any suggestions on how to proceed against a shady lawyer?

      Absolutely correct Art. What I want to find out is the least expensive way to extricate myself from the current lawyer so I can engage a different one. (and no, I am not one of those that think ALL lawyers are dishonest).

      Try contacting your state's Bar Assoc.
      We had an issue once with a divorce lawyer who keep stalling with filing the final divorce papers so he could get more $.
      One call to the county bar assoc. was all it took to straighten it out.

    yeh, and the state attorney general. I know at least in Texas there is an organization apart from the Bar or AG that investigates complaints against lawyers. I will look for it but I am pretty sure it is just for Texas...

      Thomas, it's complicated but that's exactly what I'm trying to do without getted screwed even more by the lawyer and the courts.

      Authur, For my kind of case the lawyers get paid up front. Granted, part of my problem/complaint about my lawyer is that here we are in the middle of the situation and she is asking for almost double of what we agreed upon as far as fees go to do something previously discussed.There is no way I can come up with what she is saying it is going to cost me.

      ThomM, The info I got at the site above basically said the same thing,the problem is we are in the middle of the case and consider her previous actions, I am very concerned she could and possibly would jeapordize the outcome of my case when I do that.

        Kim if she tried anything after the BAR gets involved she could lose her license to practice law there.

    That's a tough situation to be in . . . but I'm sure that if you get another lawyer to represent you, the first attorney cannot do anything to jeopardize your case or she will be in jeopardy herself - and I'm sure she knows that you could sue her for it, so I wouldn't worry about that. I know that's not much help, because I'd bet you don't want another lawsuit on your hands . . .

    I was in a situation like this once and was told by the second attorney that a competent attorney (ie. your opposing counsel) would immediately take the case into court once they were notified you switched attorney. Opposing counsel would do that because they'd know the second attorney wouldn't be able to have enough time to adequately prepare for the case, and your chance of losing would be greatly increased. So, it would be in the best interest of opposing counsel to do this.

    My (potential) second attorney was really good - and he told me that is what he would do if he was opposing counsel. So, you might want to consider finding a way to work it out with the first attorney if you don't want to almost guarantee that you'll lose your case. That's what I did - bit my tongue and was on my most "diplomatic" behavior when I spoke to my first attorney - it was hard, because I had to come up with my own defense and present it to the attorney, rather than the other way around, but at least I eventually won the case.
