SPAM question for the email marketers out there!

ok I looked on the front page and saw ever catagory BUT email marketing, so I will ask here.

I get a bajillion emails a day In and OUT of my spam folder, I signed up for something, they sold my name, and then they sold my name etc etc....

say you get your hands on 5k email addresses (Theres no source of where these emails came from) and you decided to ship out a mail offer to them ... What are or can be the consequences if you get "pulled over by a spam cop" ... Honestly, how is this different from getting postcard offers in the US mail? or How is it different from getting a phone call asking if I want to switch to AT&T long distance (providing Im NOT on the NDNC list) .....

I just really dont see how these differentiate, There is No .. Do not Snail mail me your offers list, and there is no Do not email me your offers list... why do I still get spam from sold list? how come nothing really happens to people that spam? ok maybe a few, but for every 1000 that spam 5 get caught ... kinda like downloading pirated mp3's, Is it a "blackhat" thing or what??

ok I think this post is going in circles, so If anyone can shed some light on this for me i;d appreciate it.

PS - for the record I DO NOT have a email list of 5k it was an example, and id like some light on the subject because it wont be too long before I DO start my own double opt-in list and I just wanna know the facts. Thanks again

    I wish I knew the answer. Over the last month it seems a couple of my email addresses got scraped and sold to empower network idiots who have either signed me up for their list or are using self hosted auto responders that doesn't remove my email address.

    I actually take the time to report to their hosting companies the SPAM or in one cases sent it in to a weber when I got signed up by one of the empower network idiots (vick something or other).

      Seems like a thin line altogether, anybody can enter any email at anytime, If its not a Double opt in you have no way to know.

      I was reading part of the CAN-SPAM act and it states, that you

      1. Cant be deceptive (promise something you cant deliver- or is a lie)
      2. Provide and "Unsubscribe" link - (nothing about it working - Just has to be there
      3.Contain a valid physical address

      I just dont understand whats deemed as spam...A LOT of stuff I actually WANT goes to my spam box, innocent emails are flagged everyday as spam when actually they were opted in or asked for said email

    This is why I never use my personal email to sign up or just to get some freebies online. I have a bad experience in the past wherein I need to abandon my personal email due to SPAM. My important emails are oftentimes being neglected and worst accidentally deleted along with the SPAM emails I never open anyway.

    What many consider 'SPAM' and what is legally SPAM are often two different things.

    It is not required that the emails were acquired personally or even that they opt-ed in. Many list brokers sell marketing lists online and offline.

    But you still need to comply with spam laws - not deceptive, real address and contact info, unsub option, etc.

    But sending a lot of unsolicited mail, even if it legally complies with spam laws, can get your account or IP blocked by email servers if recipients flag your emails as spam.

    So you need to be legally compliant, but you should also be aware of general attitudes and risks of unsolicited email.

        Yes, but you still have to be careful about how you go about it.

        If enough people from gmail.com or other mail service complain you could get your IP or mail server blacklisted as a spammer. If you have a server or ISP IP you need you should be careful. Even if you are 'legally' compliant.

        And filters are always looking for 'spam like' words in subjects and contents like 'free', 'offer', 'purchase' and 'viagra'. So craft your subject and message carefully.

        There are 3rd party mailers that will send to a list you provide (for a fee).

        But if you want to actually use the contacts as a reusable list you should send them to an opt-in and re-capture them yourself.

        Also be wary discussing this topic in these forums as many similar threads have resulted in the 'Ban Hammer' on the OP.

          In no way shape or form am i condoning SPAM, nor Do I practice it

          Not looking for any blackhat ways to IM, I hope mods and anybody else here understand I am trying to get the knowledge so I don;t mess things up! and can stay on the "Whilte side" of the law and practice good business ethics.

          Now with that being said I do appreciate your input and as I mentioned no such list exist in my possesion.

          All this aside basing what you said - (If enough people flag you as spam your blocked and noted as a spammer) ... Crossing my fingers but dont you run a chance of this with your VALID opt-ins? Instead of unsubscribing, Just Click Spam , It goes in the spam folder and never to be seen again! Im sure its rare, but if you have a valid list and enough people hit that button, wont you end up in the same boat?

          I plan on building my list the correct way and Hopefully never have to deal with this kind of issue, but knowledge is the key to success, the more I know, the better I can prepare. I just want things to go smooth and be the right way!

            Yes, many people don't remember or don't realize they opt-ed in and will flag autoresponder emails as spam. It is a problem often discussed. A good practice is to ask people to 'white list' the from email in your first autoreponse message when you thank them for signing up.

            Google has added a 'promotional' tab to filter the ad crap that isn't actually 'spam' out of the inbox which probably cuts down on complaints.

            It's not like one complaint and you are banned - (I know you are not doing this nor planning to but some viagra marketers do) - but if you blast 1,000,000 email addresses twice a day you can get a lot of complaints and blacklisted pretty quickly.

              Well I appreciate the insight...

              I will just do the best that I can when I start building, and I am quite sure it will be a VERY VERY VERY VERY VERY long time before I ever send out a million emails lol

              but nonetheless, lets end this thread and let it sink to the bottom before it gets out of hand or out of context.

    As long as you collect email addresses ONLY from your double opt-in forms, and as long as each of those emails meets the CAN-SPAM requirements listed earlier in this thread, you are very unlikely to be blacklisted by anyone.

    Also, it's best not to over-communicate with your list. More than 2 emails per day is widely considered 'spammy.'

    Reminds me one time I had a guy hijack my uncles email to spam me a promotion for a job to make money online but it costed $50 to join and then all they told was to spam a bunch of affiliate links everywhere, then they tried to upsell coaching on how to do it.

    Do you believe that? Can't believe I fell for even part of it, I think it was cause my uncle recommended it (sort of but not actually.) Anyways as spammy and scammy as they were they actually refunded the money, strange they didn't just go all the way criminal.
