I am unsure about the system you talk about, but they SHOULD have three types, if they want to be real strict for US tax:

    1. Citizen <<If you are not a US citizen, it isn't for you
    2. Resident Alien <<If you live abroad, not for you.
    3. Non Resident alien, for non citizens abroad.

Basically, the last one wouldn't be taxed in the US, but it allows them to do so. You would pay tax in your area. The other two would have them collect tax and record it differently.

Of course WHO KNOWS about today. The EU wants a cut TOO, etc..., if you live there.

    guruprete,

If you are a non resident alien(non us citizen living in another country), It looks like the W8 IS what you want! It explains it:

As a Rakuten LinkShare Publisher based outside of the United States, you may have the opportunity to partner with and earn income from U.S. Advertisers. When this happens, we are required by the Internal Revenue Service (“IRS”) to obtain and maintain documentation to certify your non-U.S. status. If we do not have this certification on file, we are required to apply the applicable withholding tax (currently 30%) when commission payments are made to you on behalf of U.S. Advertisers.

This certification is referred to as your W-8 status. In order to streamline our processes, we ask all Publishers, whether or not they plan on working with U.S. Advertisers, to verify their status at the point of registration
It not only describes the circumstances, as I did, " Publisher based outside of the United States", and the reason, "...required to... obtain and maintain documentation to certify your non-U.S. status" and EVEN its effect on YOU, as I did, "If we do not have this certification on file, we are required to apply the applicable withholding tax (currently 30%) when commission payments are made to you on behalf of U.S. Advertisers.".

SO, you have to fill it out, and maintain it, so they can keep proper records showing the US has NO right to the money! If you fail to do so, they will assume the US DOES have a "right" to the money, and withhold 30% for taxes! SIMPLE! There ARE various types, but they say "most Advertisers the W-8BEN is appropriate, as it is the form used primarily by entities and individuals to claim foreign status"
