Having a company name the same as someone else?

Is it ok to have the same company name as another company as long as you're in a different state and have a different logo so you're not infringing on their trademark?

And if so, is it still ok even if both businesses are in the same industry.

For instance. "ABC Marketing Group". And no, that's not the name I want to use.

    If they have a registered trademark it is infringement regardless of where you are located.

    I think it is still okay because you have different owner's name.

    If they have a trademark filed then no, otherwise if you are in separate niches then yes but if they are doing any sort of marketing or consulting then no.

    I could be wrong but I believe as long as you are able to registrar it in your state you are all set. Call the State and ask them this question they should be answer it for you.

    Its unfair to the other company or maybe both parties. Come to think of having the same name, the other is a professional and the other is a criminal.
