Question For Offliners Who Use Independent Contractor Agreements

I was just wondering can Independent Contractor Agreements be emailed then the contractor fills it out, scans it and emails it back OR does it need to be sent as a hardcopy back to me?

    I am not an attorney, but I would think either way would be fine. The courts use email all the time as evidence. I don't see there would be any difference.

    I did research of this in Canadian Law and the ultimate legal opinion of in house counsel was the other party needs to be somehow verified as the one electronically signing the document.

    How my company went about this was as follows and it is of course the lawyer's interpreted solution...The person signing would ask to take place in the program. We would call that person back with the contact information we had on record already. We would give them a 4 digit signing number that was unique to that person. They would then be shown the contracts on a secure server and asked to accept those terms by typing in their unique code and full name. If they matched our system, it was considered legally signed.

    I do not know if it is still considered a legal signature but there is plenty of resources on the net to interpret this for you. I am just telling you how a LARGE company did it and their clients were in fact lawyers so it was that much more critical we got it right.
