Will hiring sales people get me in trouble if they make claims or guarantees to clients?

This is the only thing that's holding me back from hiring sales people. I would like to know what my fellow warriors think about it. I am terrified at the thought of a salesperson lying to my clients to get the sale and me getting sued. Is there any way to protect yourself from this situation?

    Its all about training.

    Yes, some sales people will lie, some will do it accidentally
    some will do it on purpose.

    the ones who do it accidentally, don't know your business well enough,
    and they need to be retrained.

    the ones who do it on purpose , need to be fired.

    Here we go! Tell us friend, why do you assume that a sales person would be lying? Is your product that bad that it needs to be misrepresented?

    I know a great many sales people who on occassion are willing to add to their portfolio. So let me ask you a few questions:

    What's your business background?
    Have you market tested this product and if so, what have the results been?
    Who is your competition?
    What makes your product more attractive than others on the market?
    What factors have you used to determine your price point?
    What marketing materials do you have available?
    What kind of customer support and sales support will you have available?
    Is your business an LLC, SCorp, Sole Prop?
    Is your business properly funded?

    The title of your thread is:

    Will hiring sales people get me in trouble if they make claims or guarantees to clients?

    The answer is no if the claims and guarantees are true. When I do have someone out selling for me, I have a pre-written one page contract he or she has to use as their sales script. They can't say anything else. It seems to work. Other than that, the answer is still no to your question. If you ask the question differently the answer may indeed be yes.

    Most people don't know two things: 1) how to listen and 2) how to ask the right question. That ends my editorial portion of the show. Have a great day.

      The answer to your Question as OP is simple "NO" with a caveat...

      The caliber of sales person you hire will be in direct proportion to overall sales results of your company products or services. So many people focus on hiring a sales person... WHEN...

      They should be focused on hiring a Super Star or an A PLAYER who is a sales rockstar. Steve Jobs built Apple around A+ Talent only and look where they are. A great sales person will get amazing results and they can bump up sales so fast its not even funny.

      With that being said, focus on getting a High Caliber sales person and pay them accordingly....

      if you PAY PEANUTS, EXPECT TO HIRE MONKEYS!!!!

    Training and monitoring of them, record calls follow up and play them back with sales agents there, make them aware of it from start and make it clear of what happens if they break the rules

  • One thing we do is have reps act like their own business like a white label. Everything is sold in their name, they collect payments, have the contracts, and etc. We then, are just providing a service that is outsourced by those reps to us, and have no direct guarantees with any clients.

    Also, just get a very specific iron clad contract signed and make sure everything in there comes true.
