I'm confused about the spam law. People say if its commercial email it just has to include your company name, address, phone number,opt-out etc and you should be okay. But under the spam law it defines spam as any unsolicited email.

So which is it? Can I send a business an email describing my services, or do I have to get their permission first?

The CAN-SPAM Act of 2003 is also referred to as the "You-Can-Spam"Act. It allows the sending of unsolicited email providing you follow the rules. In addition to the ones you mention you should also be aware that your subject line can not be deceptive and has to accurately reflect the content of the message.

One more thing, just because you follow the rules does not mean that the people that you are sending to will not report your message as spam. So don't send spammy spam, if that makes sense.

BTW did you know that spam gets its name from the Monty Python spam sketch?
