FTC-residential telemarketing

I am having a disagreement with a friend that is doing TM for a home security company. He says as long as the list is scrubbed against the national DNC he can contact them.
I said that is NOT true unless you have a prior business relationship in the last 18 months.

WHO is correct...I have tried to Google, if you have proof, appreciate you posting it.

    IF he has a telemarketing lic. Then he is correct.

    IF he doesn't. You are.

    No prior relationship means its a cold call.

    Cold calls are regulated in every state via a license.

    Having a license or not, is the only way to answer that question.

    EDIT-

    Some companies pay for a LIC for the employees.
    For instance, 100.00 bucks and no felonies and proof you know the law
    and you can apply for a LIC.

    Companies have to pay a minimum of 2000.00
    Then based on amount of TSR the amount adjusts UP.

    Also, IF a companies goes THAT route, they then have to pay a BOND
    for the states they want to call.

    Some states are 5k for the privilege. Most are closer to 50k

    That is PER state. So a lot of companies insist that you bring your own LIC
    to the floor.

    This is only applicable for residential cold call phone sales.

    IF they bought from you EVER, you dont need a LIC to call them and sell.

    It ALSO removes the time constraint law. AS WELL AS some of the consumer protection laws.
    for instance ... "I was pressured."

    Law here says you cannot be "pressured" if you were already a customer AND HAPPY...
    another words if they never charged back ... they were happy ... they cant say
    I want my money back .. because he verbally twisted my arm.

    Here in NY we don't need any license to do residential telemarketing. We have to comply with DNC like everyone else but there's no state license on it at all thank god.
