Trademark bidding?

Nothing prevents you from bidding on a trademark term. I do it all the time.

You can even put the trademark in your ads IF the trademark owner allows you. In Google Adwords for instance, there's a form where a trademark owner can request that ads not contain their trademark. Not every owner does this: some don't care, others don't know you can do this. Sometimes, you get an email from Google that such ads cannot be shown because the trademark owner doesn't allow it anymore.

As an advertiser, you can ask the owner for an exemption. Adwords has a form for that too. The trademark owner is under no obligation to grant the request, even if you are a legitimate reseller of their products.

Google and Bing won't ban your account for this, just stop showing your ads and a message as to why. If you repeatedly try they might ban you however, their way of saying "if you don't get it, we don't want you as an advertiser" but I'm not sure if they would ban you for trademark issues.

The best way to know is to test. Not all brand names are trademarked, so you will be able to use them. Important is to cooperate and if google disapproves your ads due to a trademark policy, you will have to remove them asap, otherwise you may get suspended.
