So, I'm checking out a page one listing for a product I want to target and what do I see?

There are 2 listings in the top 10 that are using the BRAND in the domain name. Both sites are your typical AdSense site build around the course Xfactor is offering, etc.

Having experience in helping companies fight this stuff (IP law), I know for a fact that I could contact the legal department and wipe these two sites off the map, thus freeing up space for my site to take one of their places.

My question is this:

What would you do?

1. Ignore it and go find something else.

2. Ignore it and go after the KWP anyway.

3. Report them to help the company fight trademark infringement against people who can't seem to follow the law.

4. Keep this as the ace up your sleeve by entering the market anyway and only report them if you can't leap over them.

5. Or something else.

Just thought it would be interesting to see what the responses were.

And yes, if you're currently building Adsense sites and using a TM name in your domain, I'm talking about YOU.

    or, you could ask for links in exchange for your silence.

      Using trademarks and copyrighted material is perfectly legal.
      Here are some instances that are very popular:

      Fan sites. Just pick a celeb. There are oodles of domains with
      stars, movies, etc in them.

      Hate sites (or anti sites) Already are legal, such as Ihateford.com,
      etc.

      Using competitor in advertising: I'm sure you have seen many, many
      ads like GM, "We're better than Honda!"

      This is just 3 popular instances.

      There are countless more. How many game sites with xbox in them?
      Lord have mercy! probably a ton!
      Perfectly legit and legal.

      Now you cannot pawn yourself off as an "official page" unless you
      really are an "official" page. That's why domains have the words
      official on them and want you to know it!

      Many, many sites have the disclaimer, "We are not affiliated with..."

      I just thought of apple and google. Holy cow! How many domains
      have those words in them?

      I knew the beatles had a ton of those fan sites. Just found one creative
      person that got "beatles" in there as: mybeatlescollection.net

    Personally I'd feel like a huge jerk for reporting them but some have a different moral compass than I do so...

    I would do #2.
