Angelas and Paul Lists Getting me in Legal Trouble

I bought a bunch of angela's and paul's backlink packets and had my link builders build links on the sites. I just got a call (I run a local business and our phone # is listed on the site's contact page) from a server admin saying he just spent 30 hrs clearing out all the links from the sites on his server and that he stored all the IP information and will be suing me for SPAM.

WTF?!?!?!

What is my recourse here?

    He is just threatening you, he'll not be able to sue you for this.

    However, Make your domain registration private, at least after this.

    He said he's going to talk to his attorney on Monday about suing me along the lines of can-spam act ("violated disclosure portion of Can Spam") etc. And then talk to my State about my business...

    Am I in trouble here???

    The CAN-SPAM Act only deals with email.
    That doesn't mean he can't sue you for some other reason though.

    Tell him to suck it. And get those link builders to replace those links quick.

    Just tell him back that if he don't remove your name from his website you will sue him, also explain him there is no way he can sue you - Seriously

    He can't do anything legally against you but you can sue him for mentioning your name in public

  • Anybody can sue you for any reason. The burden of proof is on the accuser. But the question you have to look at now is can you afford to fight in court. Court costs accrue quickly.

    I for one am damn tired of spam in all forms, comment spam especially. I have shut down comments on most of my blogs because it costs me time (Which is money) to deal with it. So it effects my business and that is lost income.

    It also effects my business because comments are a legitimate way to communicate with potential customers and shutting them down also costs me money.

    So yes you can be sued.

    And the type of linking done from These Bookmark packets is annoying and almost always spam.

    Your best bet is to talk to an attorney. The thing about court and the law is this: Ignorance of the law is not a defensible excuse.

    If you are not incorporated there is a good chance they can come after your personal assets.

    The people hear saying they can do nothing are not business people and do not understand what happens in the real world outside of their own little IM Bubbles and pretend businesses. Most are not incorporated, have no Tax ID, no Business License, no real assets to attach.

    How do you think Monstanto Chemical has dominated the Seed Market in this country? By suing Farmers... then bankrupting them in court until they can move in and take whatever they want. You don't have to "win" to win. And people with deep pockets nearly always get what they want. So find out if this place has any real money behind them. And you should refrain from any contact at all with this person. The less you say the better.

    I don't know how tracking IP's is going to benefit the person suing you because they will not match up to your company. You might want to consider shredding any documentation showing you paid anyone. Make it as hard as possible to prove anything. Court costs run both ways... the more they have to spend to come after you... unless they have really deep pockets, the less likely they are to pursue this. If the person accusing you is out of State that is even better for you, because they have to serve you papers and that costs more if they are not local.

    It's likely not going to amount to anything but the time to act is now.

    Good luck, and this is a good post. Most the people here do not have bricks and mortar businesses so they would be much harder to sue.

      Thank You! I'll cut off all contact and shred any and all documentation I have. Hopefully, he'll just drop it since I won't be going near his, or anyone else's sites.

      Not be offensives but they're something called Comment spam prevention for your blog - Akismet.

        Even on low PR blogs with Akismet, I still get a ton of comment spam. Do you not? Maybe it's just my niches.

          I don't about 10% of those comments get through. That's about 10 a week and most of time time they're in my spam Inbox. I get around 90-97% block rate. Well worth it. Saves me so much time.

    Obviously this person's web site provided a place for people to register and leave links. Your employee (the person you hired to do the commenting) simply availed themselves of their offer. If they didn't want people to register and leave a link, then they should not have provided the means to do so. It was only logical for you to assume that as they provided the means to leave those links, that they wanted people to leave them.

    Anyone can sue anyone for anything. Talk is cheap, lawyers cost big bucks. I wouldn't worry about it if it was me. Not very likely that this will go anywhere past the fellow calling you and threatening you. You might want to spend a couple hundred dollars to verify your position though, just to make yourself feel more comfortable. None of us here can give you legal advice, and few of us know what we are talking about.

    One thing I'm not catching here: How many links did you have on the guy's site(s)? 30 hours is a long time. Was he saying that was for your links, or just for all the spam on his entire server?
