Using Icons/Images on sites I will sell/flip - Understanding "do not redistribute"?

Anyone truly know the answer?
Or, perhaps have it on "good authority?"

When it comes to understanding what they mean?


"Free for commercial use (Do not redistribute)"

(then, further expounds...)

"This product may be used free of charge for personal or commercial purposes."

"You may not modify, sell or distribute this file on any websites."
Those are the directives I find associated with quite a number of icons/images on various online "libraries" or photo/icon repositories. I often find verbiage very similar.

I'm trying to make money at flipping a few sites or affiliate type blogs selling Clickbank or some other IM products - no rocket science. I'm using existing WP themes. I will just be some of the images/icons I will insert into a post, or maybe a featured image. I will not "sell" or specifically "distribute/redistribute" any icon or image. Selling or redistributing "icons or images" is not my kind of thing. But, you need them "sprinkled" here or there on your blog to make things look pretty!

I take the meaning of those blue statements as ones targeting someone who is specifically re-selling said icon/image, or anyone who is specifically distributing said icons/images. I do not take it to apply to my situation of selling a website, with an icon/image "incidentally" on it. But that is my interpretation.

For me:
  1. I really need to get a general understanding of what is meant
  2. I do not really want to email the "creator" of the image/icon
  3. I really want to use these particular ones that have these directives

Trying to interpret GNU licenses and the like, has it's own specific set of challenges. In some cases the creator of an icon or image chooses (specifically) not to offer a license, and instead chooses to provide "written" instructions.

    I've always interpreted this as stating you can't take the picture, slap a price on it, and sell/distribute the picture. Never had a problem.

    I think it also really applies to selling the images directly.

    Most sites today have images/icons/buttons etc. that are not original, and I doubt they could even find you even if it was an issue.

    That being said the only "gray area" I can see where you may have an issue with is the actual theme of the website. Say if you are using some custom theme that isn't meant to be re-sold, I can see that may be an issue.

      Thanks johnny - I interpret it the same way, just worried that my purview may not necessarily been the way others saw it as well. But the more feedback I get, the more I am starting to believe that it really does focus on those who are intending to profit directly from them, rather than incidental usage..

      Thanks gyuman - Yes, I everyone I've mixed with seems to have the same take on it; of which I am certainly glad. I want to make certain I am on the "good side" of legal.

      To that point, I found out that using googles image search can find your website if you use an image. I have no idea how it does it!

      So I tested it - I found the original image url, from where I had downloaded the image on the icon library site. I plugges it into google images the using the "search by image" ...

      Once I did that google came back with serps. My site came up in the results!!! I do not know how it finds you - but it does. I changed the name of the image - it didn't matter it found it on my site nevertheless. Their must be some code imbedded somewhere on it.

      SO! I would rather use the image the proper way, rather than having someone who doesn't like me as a competitor on lets say "flippa" complain to flppa that I shouldn't be using it - and the next thing you know flippa banns you. Site flipping competitors are as bad as they get! It seems to be rather "dog eat dog." And, like those who used (me to post on CL, competitors will "turn you in" if they can...

      I just want to make sure I do my research, before I assume, because it appears the "image police" can find you!

        Unless you're talking about an obvious trademark (like the logo of another company) or you are actually selling the image itself then you have nothing to worry about.

        There aren't actually image police. The only person who would or could get you into trouble for using an image are the original creators or owners of the image.

        However, it seems like you are talking about some piece of clip art. If it was uploaded to some kind of image repository then people are expecting you to reuse it for exactly what you're planning to use it for.
