i'm getting into a new niche, i have a partner who owns a website that is in the same niche. if he has a page created in 2005, last updated years ago, same niche, would the adding a backlink benefit me? or would google see that as a spammy link.

depends on the PR...link profile...and overall relevance of the site...

Of course they wouldn't and of course it would (depending on the link i.e. the quality of it). But even then, it's just one link and as I'm presuming it's NOT coming from BBC.co.uk, it's not really going to revolutionize your visibility.

That said, worth having if it's a decent link - just try and avoid having to give him a reciprocal.

More important point is whether the page is even indexed (use the site: command to find out).

What rjames said. It depends. What PR is the site? What is the Page Authority? What is the Domain Authority? What does its link profile look like? Etc.....

Install the firefox plugin called SEO quake to see page rank and alexa score for all your search results! If it's not in the top 15 of Google page ranks it's not worth spending that much time on!

The age of the domain will help, so is the relevancy. So yes it will be helpful for your website regardless of the PR value. Only make sure the webpage is indexed by Google.
