I think so, you cannot de-index other's property, we do not have right and permissions for this. What you can do is just send complant to DMCA regarding this matter. This will make your content secure and unique, if it indexes first in google indexing.

Neither would I want a link from such a site, it would do more harm than good.

I have brought down sites/pages in the past, using DMCA. They take hosting from hostgator which is another good thing, as I've found their abuse team to be quick and helpful.

I've never got anything de-indexed though, so thought I'd try something new this time.

I would first contact the site owner and try to kindly ask him to edit or completely remove your article. This webmaster could also link to your website! So, I think DMCA will work if ONLY you didn't manage to cope with this problem!

Why are you wasting your time trying to find ways to get it deindexed?

Send the DMCA notice to the host and be done with it.

Google probably gets flooded with these kind of complaints. Could be weeks until they get to yours. If I am not mistaken, they are under no legal obligation to comply either.

On the other hand, the webhosts can get into legal trouble for not complying. They are quick to take action.

  Yes, there's a couple of ways to go about it. I usually do both...the "Complaint" form and a DMCA. The important thing is to not let these thieves get away with it, otherwise they will rip even more of your pages once they see you're an easy mark, and posing a threat to their Adsense account really gets their attention. I've done this numerous times and most were successful.

DMCA notice? I would not waste my time.

What if the guy is outside the US? Nobody gives a rat's
hat about US law.

I can't imagine google taking an interest in everything they
get submitted either. Unless it's from a court or lawyer.

You have a very small site that basically just rewords what
google publishes. I have no idea why people go gaga over
copied content...

That's because you don't know what you're talking about.

It makes NO difference if the thief is located overseas...their Adsense is in the US.

These thieves steal content so they can put Adsense on it. When you send Google a properly formatted DMCA notice and an Adsense complaint, Google WILL take action. I've filed close to a hundred of these things and 99% of them were successful.

Once the thief sees that they are removed from the serps AND may lose their Adsense account, there's no reason for them to continue ripping content. You just removed their financial incentive.

That's pretty much what I was getting at, reporting to Adsense.

Without an income, the scraper site isn't interested in stealing content.

Site is hosted in US, so the Host (hostgator in this case) is bound to act.

It takes a lot of time creating well researched high quality content and while these impostors just copy/paste it without giving any credit. I don't see why someone you should not fight against such people.

  One more note...
  
  I never waste time trying to contact the offending webmaster...they already know they stole your content.
  
  Also, if they are NOT putting Adsense on my stolen content, I use a standard DMCA to Google. I've had Google remove an offender within 48 hours in the past, however it now takes much longer for Google to act since more and more people have figured out that it works a high percentage of the time and Google is receiving tonns of DMCAs every day.
  
  If they ARE putting Adsense on my stolen content, I try the complaint form that Yukon mentioned first and see what happens. The complaint form seems to work much faster than a full-on DMCA. But, if it doesn't work...DMCA to Google.
  
  The only time I can think of that I wasn't successful was when the thief only ripped-off a small percentage of my content. (two pictures) So, I presume Google has some threshold they use to decide when to act.

Yes, scraped content/pages can easily out rank the original content source/page.

Not all content is the same though. If you scrape Amazon, you'll most likely get buried in the Supplemental SERPs (eventually).

The best way will be for sure to contact him and ask to remove that content, if it will not you can try with google, they will help you. But believe me that if that guys reading emails it will remove that content.

I would advice you to contact site owner and ask and explain him your situation. I bet he will understand you. But thing is when he dont want to take it off you should be able to prove that its your content
