Help regarding google penalty

Hello,
One of my site received a google unnatural link penalty. I have registered a new domain and want to start a new site.
My questions are:
1. Does my site agave to be different in its design of can I just take the old page designs and place in the new site?
2. Do I need to first due index the old site before doing the new?
3. Is there anything I can use from the old site?
Any help would be appreciated.

    Are you creating a new site just because you got the penalty?
    It would make more sense to use a tool like Ahrefs to check your link profile and disavow any spammy backlinks to clear your site of the penalty rather than creating a new one.

    If you insist on creating a new site than you could use the old design but using the same content will be deemed as duplicate.

      Thanks ElusiveEnd for the super quick response.

      I am thinking of a new site since the domain itself isn't super important and when the initial penalty occurred we took someone to handle the cleanup but it wasn't done properly so got rejected. my thought is that now to submit a new reconsideration would be harder since it already got rejected once.

      my understanding is that even if the existing site gets cleared it will still be hard to get its rankings back up so my thought is that it may be a better investment of time to work on something new rather than the existing.
      what do you thing?

        also, with regards to duplicate content.
        if i deindex old pages, wouldn't i be able to use their content?
        again-any help would be appreciated.

          Yeah sorry, I wasn't all that switched and didn't think to include that if you did remove old content than it may be alright to re-use on the new site.

    The process goes like:
    1. Canonical tags on old pages pointing to new pages
    2. Put 301s in place
    3. Hard launch new site

      I'd be careful doing that.
      Both 301's and Canonical's do pass link juice. This essentially means that you may actually pass the unnatural links to the new domain.

      I can safely say that if you do create a new domain/site that you should not 301 or direct any links from the old domain to the new one. This is based off of my own previous testing and that of others.
      Although some people have claimed that 301'ing a previously penalized domain to their new one without any negative effect I would be skeptical in doing it. Just as many people have done the same and did receive a negative impact.

    if i do not do a 301 redirect. do i just put a 404 on the page?
    if its a 404:
    1. can i have a link on the 404 page to the new domain?
    2. can i have some automatic javascrip redirect or something similar on the 404 page?

      I'd remove the site completely rather than adding a 404 page.

      1. You could, but I would advise against it because it would still be within that bad link neighborhood that got you the penalty in the first place. Meaning it would then pass the link juice to the new site, essentially giving it the unnatural links.
      2. Again I would advise against it, for the same reason mentioned above.

    Delete the website
    Park the domain or something
    Don't 301
    Wait till site is fully deindexed and reuse what you need.

    so do you think that just have the old domain have a one liner saying
    "we moved to www.newdomain.com click here" is problematic or is this OK (where the url is hyperlinked)? i am thinking of methods to let visitors know about the move...

    I would still avoid adding a link there.
    You could however add the new domain as only text rather than a link on the 404 page to tell people where it has moved. I suppose if it is not a link than no juice would be passed which should negate the effect that the bad links may provide if they were to be passed to the new domain.
