Does an ad need to appear in browser window to count towards CPM?

Quick question from a newbie guys:
If I place an ad say at the bottom of a page and users never scroll down and see it, that still counts as a view right?
If the advert is below the fold and users don't scroll down it'd still count as a view because they've loaded the page, wouldn't it? Like if it never appears in the browser window because they don't scroll down does it still count towards CPM?
Does google have any rules against this?
