Do Not File a Tax Return During an Audit

Generally, your income tax return cannot be audited after three years from its original filing date. There are a few exceptions to this rule, however it is fairly rigid. The few exemptions that apply involve tax fraud, under estimating your income by 25% or more, and non filed tax year returns. Audit notices are usually sent between 12 and 18 months after your return has been filed. Generally if you have not received an audit notice from the Internal Revenue Service within 18 months you should have no concerns.

There is a long standing rumor that the pre-printed IRS mailing label flags your return for auditing. This has not been disproved, however, according to the IRS, it is all quite innocent. The label tells their computer where to enter the information from your return and tells the post office where to deliver it. It is not an audit flag. The IRS accepts the vast majority of tax returns without question. On an annual basis, approximately one-half percent of the returns are selected for audit. That leaves 99.1/2 % of the remaining returns scot free.

Now if you should happen to be among that one-half percent that are selected for examination, as the IRS likes to refer to it as, you should not file a tax return while an audit is in progress. You should avoid doing so even if asked to do so by an auditor. You risk having the audit expanded to include that return. What you should do is file a request for extension until August and then again on October 15 if necessary.

If the audit is still alive on October 15, consider not filing a return that year or until the audit is complete. If you have paid all taxes you are responsible for, you won’t incur any penalties or interest for not meeting the filing deadline. If you believe you will owe additional money, calculate how much you will owe and send in your payment with your letter stating that the payment is to be applied to that year income tax return.

If it is too late and you have already filed your return while an audit is in progress, politely refuse to give a copy to the auditor if they ask. Do not sign any forms granting them authorization to access that particular record. And if they become very demanding agree to provide it only after they produce written documentation on IRS letter head confirming that access to that information is necessary, why it is necessary and which tax code provision allows them to demand it. They will not be able to provide said documentation.
