if you have the script on your site, lets say, mysite.com, someone visits mysite.com, and the affiliate link(s) are automatically clicked.. NO REFERER is passed... your affiliate manager has no idea where the clicks came from, they just think someone entered the url directly in the address bar... they CANNOT tell the clicks came from mysite.com.

besides this, there are no other precautions... but the affiliate network can never know you are stuffing cookies on your site. all the features in the script are laid out, nothing held back, nothing over exagerated...

When does someone ever enter an affiliate URL by hand in the address bar? Isn't tons of clicks on affiliate links without a referrer even more suspicious to your affiliate manager?

Dan - you would be shocked at the 'gurus' using cookie stuffing - I had this happen to me in a recent launch - happened to check the clickbank referrer code as I wanted to make sure it was correct for the particular bonus I wanted - I was shocked to see someone else's code - and it was from a site I had visited the day before BUT NOT FOR THIS PRODUCT - although he had a review of the product on his site.....I DID NOT click on any link to visit the product page - technically, no cookie should have been dropped.....BUT there was his referrer code on my Clickbank page!!

The worst part? The cookie was cloaked so I had no way of clearing it without going through and checking every cookie. Good for him.....not good for the other affiliate whose link I DID click through to buy!

I wound up buying from my laptop!

And this is a name you would recognize immediately!!

if i have a website, www.hornymonkeys.com, and it forwards directly to my affiliate offer... I can put the offer in google adwords (cloaking affiliate link), newspapers, radio ads, tv ads, hand out business cards, word of mouth, direct mail ads etc etc etc. Ive dealt with azoogle, cj, and many other big affiliate networks and have NEVER had any trouble getting paid ddue to no referer. the proof is in all the different offline methods I gave you above that are possible.

Shawn Hogan, owner of Digital Point, is being sued by eBay for cookie stuffing as we speak.

eBay Sues Alleged 'Cookie Stuffers'

SAN FRANCISCO (CN) - Three men defrauded eBay in a "cookie stuffing" scheme that made it appear the men's companies should be paid commissions, eBay claims in Federal Court. It sued Shawn Hogan and Digital Point Solutions, Todd Dunning and Kessler's Flying Circus, and Brian Dunning and Thunderwood Holdings.

eBay says the men devised software programs that, "unbeknownst to the [computer] user, redirected the user's computer to the eBay Web site without the user actually clicking on an eBay advertisement link, or even becoming aware that they had left the page they were previously viewing. As a result, the eBay site would be prompted to drop an eBay cookie on the user's computer even though the user never clicked on an eBay advertisement or even realized that their computer had ever visited the eBay site."

The complaint continues: "once the cookie was stuffed on the user's computer by one or more of the defendant's any future revenue actions initiated by that user when the user later visited eBay intentionally, and not as a result of any advertisement places by defendants, appeared to be eligible for commissions payable to one of the defendants".

eBay claims the defendants also used deceptive means to prevent it from discovering the fraud, and to conceal it. eBay demands compensatory, treble and punitive damages. It is represented by David Eberhart with O'Melveny & Myers.

Rofl... Dan you are absolutely hilarious... do you know how big digital point is? Everyone knows cookie stuffing is against ANYONES tos... digitalpoint is a huge site which many ppl go too, so when ppl at ebay visited the site and saw them stuffing cookies, they filed a lawsuit...

if someone on here uses their small site, or a webpage, to post on youtube or craigslist or something, they have nothing to worry about. You might want to go find something more productive to do

Dan to be fair it might be against the TOS of networks and BlueFart but it isnt illegal so i dont really think you should hijack someone elses WSO that they have paid $20 to run.

ISN'T ILLEGAL??? I'd re-think that. If there is nothing wrong with cookie stuffing then eBay would not have grounds for 6 charges including mail fraud, wire fraud, racketeering and violation of the Computer Fraud and Abuse Act.

I just did a huge blog about this and tons of research and I don't think you guys realize what's going on here.

This is a civil complaint. Anyone can file a lawsuit against anyone else. The filing of a civil lawsuit does not prove they have grounds for any criminal charges or that the defendants have done anything illegal or even anything wrong for that matter. That will be up to the courts or a jury to decide if it gets that far. Having said that, I have no doubt that eBay believes they were harmed and has evidence to support that. eBay is diligent about enforcing their TOS with affiliates, buyers and sellers and surely has all kinds of sophisticated tracking and metrics in place to thwart abusers.

It's just like the steroids issue.. for every 1 that gets caught, 10 get away with it because they can mask it better.

It's pretty hypocritical... all these big companies and IMers use it... but if someone else does, they sue.

This is just a tad technical and I am not quite following exactly what is going on here. But the one thing that does come through to me loud and clear is that this involves STEALING. There is stealing by fraud here. I don't understand the process that is being used to get paid for these cookies, but they are being placed on someone's computer fraudulently and in someway used to get paid with, unless I am missing something. You can say that there is no illiberality here, but you are blowing smoke up your own rectum by claiming that. This is outright fraud, and no amount of suggar coating is going to change that. IF it's stealing (instead of just a more aggressive form of adware), then the bulk of the criticizing should be directed at the parties doing the bulk of the stealing---namely, the above mentioned major sites and gurus who have been doing it without the slightest peep of outrage. As everyone can see, I openly stated the so called audio issue after you complained, before your post. So trying to paint me as some crooked vendor is going to fail.

In your original PM to me, you said you were trying to stuff ebay links.. show me one ebay affiliate link that plays audio when you visit it. You also said via the email, that "one" of the affiliate links is playing audio, so that obviously means you are using it with other affiliate links satisfactorily.

What you're basically asking me, is if I was a car dealer, and you come buy a brand new corvette from me... but then when you drive it, you learn that out of the tens of thousands of cities in the united states, you cant drive the car in 50 of them, because they ban corvettes. You expect me to issue you a full refund, when the car I gave you operates EXACTLY as advertised, but since you cant drive the car in 50 cities out of 30,000, you want a refund and keep the car??? Fact - I did not try to use the script with Ebay links. I had asked you if the script worked with Ebay, that's all.

My primary use of the script was to be for other affiliate programs, such as Clickbank, etc.

You didn't put anything in your WSO ad until AFTER I emailed you about the audio issue. If you would have mentioned the audio issue before my purchase, I would not have been interested in buying to begin with.

In regards to your statement "But, this is not your run of the mill garbage script, as it is packed with features!" - I fail to see any remarkable features, unless you consider setting a delay time before cookies are stuffed as being something that's really 'leading edge' technology.

There's no provision to rotate cookies, no percentage of visitors stuffed, no cookies stuffed tracking - none of the features that come with advanced cookie stuffing scripts.

As they say, we all learn as we go. I made a mistake when I bought your script. It's not the type of mistake I'll likely repeat.

The bottom line is that you have my money and refuse to issue a refund, but that's OK - I can live with it. It's a small amount of money, so it won't change my life and I won't lose any sleep over it.

Jusumax, you can say whatever you want from this point on and I don't care. I've wasted my time and money with you and I will no longer waste anymore time on this matter. I hate to do this but i've never seen someone do business like this guy jusumax. I buy his WSO listed here and little do I know that is all about pushing dating site offers and selling yourself as an escort site (SOMETHING HE DOES NOT ADVERTISE AT ALL IN THIS WSO).

Second, I tell him that I cant do this activity as it is against my morals and not something I want to do. I would guess it would look the same (no referrer) if you visited from a bookmark that you saved from a previous visit, or if you clicked a link in an email you received in a non-web based email client.
