Worried about copyrighted images

So I have been hiring some awesome graphic designers on Fiverr for my headers and they have been doing some awesome jobs. I assumed the pictures they use for the headers they get from some Stock galleries that they are allowed to use. However, the other day I asked for a header and attached some images from other websites portraying what I would like. I meant for this graphic designer to use the image examples for inspiration, instead he/she used those same images for the header!

I refused the header because there is no way I want to use somebody's else pictures! So now I am worried about the other headers I had done by this designer. How can I know whether the pictures are OK for me to use? How can I protect myself if one day somebody comes to my website and says 'hey this is my picture!" I feel tempted to not use them and debating on whether I should take them down. I would hate to use images that are copyrighted!

Well, it's Fiverr. You can safely assume that the vast, vast majority of designers are using stolen images. Yeah, I'm sure there are 1 or 2 ethical people out there, but the odds are against you.

The only way to be sure that the images are legally obtained is to know the exact source of the images. Even stock images cost money. You might want to require the designer to submit any images for your approval. You can then buy the images yourself or provide the funds for the designer to do so.

I was reading the terms of use and am deducing that it's against their terms of service for sellers to do so. When I read graphic designer, and things like :"I will design a header for you" I imagined that they would create it entirely on their own from scratch, using their skills. Heck, even I can copy images and make a header in no time! The issue at the moment is being taken care of the company's Trust and Safety team. They have already refunded me the costs and I have removed the headers.

I wrote about this a year ago.

If you are using images from someone you will receive and email demanding a payment or will be taken to court.

it happened to me some years ago, they call you and tell you that even if you delete the site they already have an screenshot "they showed it to me" I got scared and deleted my site, lost hundreds of great articles and information. I had so many images I wasn't sure were co pyrite free.

Anyway, if your designer don't tell you were she got those images then you are at risk not them. So ask them to show you their source or dont use them. All my images I use for my clients are checked by me so that does not happen.

Did you actually go to court over this or did you settle?

I would require them to provide the source of their image they use. State to them it is only to protect yourself legally to make sure the image isn't copyrighted & not available for re-use. Explain you use them because you aren't a designer & realize there are many free stock photo sites out there already.

You may want to require them to use images from sites like Pixabay or even provide the images to them you know are OK to use them. CC0 images is what you want or those you personal have purchased on stock photo sites.

As Starlyn said - you are the one at risk. Here's one horror story about a potential $8000 mistake - http://www.contentfac.com/copyright-infringement-penalties-are-scary/

Might not be the legal line to tow, however the worst that'll happen is you'll get an email asking you to remove.
