How does my Pop-up Form Look?

Just put a pop-up form on my site. Not sure if it looks good. Any ideas?

    Hi Mike,

    Tried looking at your pop-up from visitor's perspective.

    I think your pop-up looks cool... sharp and attention-grabbing. I realized you have 2 different images (or maybe more) on rotation or something.

    Maybe you can split-test with another set, with the top headline put at the bottom and the bottom at the top. Reason being, (some) visitors will look for the "close" button immediately when they see pop-ups but if they see the word "FREE" at the top, it can increase the chance they'll read everything...

    Also, consider putting the email privacy statement away from your pop-up and add a simple privacy policy page instead. This one is my personal opinion though...

    It looks good, but I'ld change the background color from black to something to lift the spirits and make me want to JUMP INTO the
    submission form.
    That black is very depressing. You need a brighter, happier, more mellow color, something to make people feel comfortable while at your site, NOT uncomfortable.
    What I mean is, people are coming to your site to make a lifestyle change, and odds are, they are disatisfied with the way they look and
    very depressed about it already. So the first thing they need is a subliminal push into a lifestyle change that FEELS GOOD to them, and the first thing that will help them step into that change IS the first impression of your offer to help them. A bright and cheery PROMISE of the good health and overall well being that are to come because your program effects that lifestyle change. They NEED to believe. This will help them do that.

    People can actually read your content underneath the pop-up from, and not try to use a better picture that does not measure waist but rather fitness!

    Maybe you should try to write some big red text or something in the headline, since you need something to catch the visitors eyes before the visitor close your add
