Can the network go without paying me?

A few months ago I made a few hundred $$ with a network (I'll keep them nameless) selling a popular haircare product.

At the time, I cleared with my account manager that using a trademark domain was fine.

A month down the road the product's company decided they would not pay the network as they had changed their tune on the use of TM in domains.

Therefore, my account manager told me my commission was stalled until the resolved it with the product's company.

It never went anywhere, and I've not been paid.

As, at the time, I was given the all clear and proceeded with a TM domain in good faith, should I still be paid by the network?

Just wondering where I stand as I wasn't part of the problem, and have am owed $$$.

  • You should talk that through with a lawyer, not with an online community.

    Everyone will agree that you should be paid of course, but it will be hard to come by the money without pressing the issue in some way.

    • dont bother with a lawyer they will end up charging you more than you are owed by the network,
  • If you had worked with reputed networks you would have got payments by now.
    All your leads where generated last month and they didn't have any restrictions on TM on that time, so when they check now they should compare with the rules that were placed at the time when leads where generated but not with the new rules. This is truly UNPROFESSIONAL ACT.

      If you was giving the okay from your AM and later the advertiser ruled against it then that is the fault of the AM and the network in our case anyways would have to bite the cost. I personally think this is a all time low, Am said it was okay, Advertiser said no and you suffer? That is BS the Am should stand up and have some dignity and accept fault and assure you get payment. I would of packed my bags and left that poor excuse of a network in the rear mirror
  • Obviously we don't know all the details about this particular situation but the thing that needs to be remembered here is that all the money comes from the advertiser. If the advertiser doesn't pay the network, they can't pay their affiliates. They control everything.

    There's also the fact that sometimes permission is given for something when it really shouldn't have been because they didn't clear it with the advertiser. In that case, it's the network's fault and they should be held accountable.

    • That is a bull crap approach. Maybe for networks that do not have a clue and do not make any serious money.

      I been running a network for over a year and i do not make what never blue or max makes but i assure you i do pretty good. With that said if i insisted a pub run a certain way or advised him his way would be fine and then the advertiser got cheap and did not pay your saying your solution is to screw over the publisher because the network picked a piss poor advertiser to promote with? No the proper thing to do is dig in your pocket and take the few hundred out of your networks thousands of dollars profit and pay the pub then ditch that advertiser.

      There is only one thing we will not pay for that is proxy leads we will not reward fraud i do not care how bad we are down talked, However everything else gets paid even if We decided to promote a advertiser that looks for any reason to get out of paying.

      You do not punish a publishers for your mistakes period. I don't see how that is a smart business move

  • Sorry for such a scenario. There is nothing much to with the network at now which can ensure your payment. Engage a lawyer to follow up the issue. Next time you have to be careful. Get to understand the reputation of any website before you deal with it.
  • Obviously the network should pay given the scenario given. Do you have any proof in writing or electronic that someone from the network said there would be no issues with the domain?
  • Just move on.. Try to promote other products and get leads. But I hope you can get your payment soon..
  • Oh! Is so unfortunate. Try once more and push the network to pay you. If it won't work try to contact a lawyer for some legal advice. Otherwise this should bring you to attention on what networks you deal with. It is better to fully acquaint yourself with a website before contacting any business with them.

  • in this kind of situations the networks would always win a lawsuit, since you've agreed with their terms that probably cover them. I know this isn't the answer you where looking for but that's how it's probably gonna get down.
  • I'm pretty sure most networks have in the TOS that they can deactivate or cancel any account without any reason.

  • I agree with Maraun. Make sure you get legal advice before you take any action.
