Hey everyone, I am planning to sell one product on eBay, but my supplier said that this product is a clone. I've did some research on eBay, and I've seen that many sellers are selling the same clone successfully, and are maintaining a good feedback.
I have a feeling that the original design of this product is not copyrighted. But how to find out if it is copyrighted or not? Thanks in advance.

    Hi, Antis,

    You mention a "supplier" in your post. This person accuses you of using a clone. Here are a couple of suggestions:

    1. Find out if your "supplier" is actually a competitor who does not want you selling the same item.

    2. Ask your supplier to provide the original author information for the item.

    3. Contact other providers of the item that appears to be a clone and ask them for their sources.


    You might have to go around this person to sell without his permission or approval.

      Yes, but it isn't easy! Private label can make things a bit easier, but that has it's own set of challenges.

    Good luck with that idea. Imagine if you were successfully selling a product and a stranger (or even an acquaintance) contacts you and asks you for your source. What would you say?

      What if I will just contact him as a buyer, and ask where the product is manufactured? (Originally it has to be manufactured in US, clones are manufactured in China)

    Forget about selling clones, counterfeit items and stuff like that. Be a honest seller. Forget getting rich quick. You won't go anywhere with this kind of strategy. Making money online is hard work.

    Usually physical products can not be copyrighted unless its a like a book or CD. However they can be trademarked or patented.

    Either way, its best to avoid these products unless you want a lot of legal expenses and headaches.And don't necessarily trust Asian suppliers to be experts on Western IP law. They usually aren't.

      Ok now another question that might sound stupid: how to find out if the product is branded or not? All the chinese or not chinese products has something written in the brand section. Has this section be empty if it's non branded?
