Amazon FBA white labelling question. Is this ok to do?

Hello,

I found a branded bag on Amazon, not a very big brand. Now, I found the same bag on alibaba. I didn't thought much at first and wanted to buy and sell on amazon, then on a little more research, I found same bag, much cheaper but no logo. Then I realize that the brand owner is just putting his own logo on this bag/white label product. But he have done work in promoting his brand already. So, does it means, I cannot sell these bags am I correct. But provided the real item is made from the same source. I'm new to this. Can you please tell me what is ok to do and not ok to do.

    The first thing you need to check is whether his brand is a registered trademark. You can find most registered trademarks by searching here: https://www.tmdn.org/tmview/welcome# Last time I looked they listed over 50 million names worldwide and the number is growing daily.

    If the trademark is registered, it would be risky to try to sell copies on Amazon with or without your own brand. If it is not registered there should be no problem in you buying unlabeled bags and putting your own label on.

    Just putting a label on, as advised by most private label experts will only show people that you are a different supplier, but it will give you no advantage in selling unless the label is outstanding.

    Why bother to just show that you are a different supplier, when by spending a fairly small amount, and by thinking about what will attract customers it is possible to build a great brand.

    lot's of sellers put their own branding on a generic item.

    you can do the same or sell it without any branding, but you won't be able to piggyback on other sellers listings.

    Putting your own brand on a generic item that has no trademark is not a problem unless the item is subject to a patent or copyright.

    You can still sell the bags, even if you actually don't label them (leave them generic).

    What you can't do is to take that alibaba product, label it with the same level that brand owner is using on Amazon, and sell it on your own.

    I think you should not sell branded products that are owned by other third parties. If you want to sell item under their brand, you should ask for permission to sell. If not, they will report you and Amazon will suspend your listing, or even your account.
    Besides, I think you should build your own brand by registering to the trademark agency and registering Amazon brand registry to protect your brand.
